Is using online motorbike insurance against the law in Vietnam? How much is fine for motorbike drivers who do not carry insurance in Vietnam? When an accident occurs in Vietnam, what is insurance buyer's responsibility in Vietnam?
Hello, I have a problem that needs to be answered. Recently I have seen people selling motorbike insurance online through many forms like Momo. I wonder if using online motorbike insurance is against the law?

Is using online motorbike insurance against the law in Vietnam?
Article 18 of Decree 03/2021/ND-CP stipulates obligations of insurance buyers and insurance beneficiaries as follows:
In addition to obligations under Law on Insurance Business, insurance buyers and insurance beneficiaries have the obligations to:
1. Cooperate with insurance enterprises in inspecting vehicle conditions before issuing certificates of insurance.
2. Promptly inform insurance enterprises to adopt appropriate insurance premiums for the remaining duration of insurance contracts in case of changes to factors which serve as the basis for calculating insurance premiums thereby increasing insured risks.
3. Always carry valid (physical or electronic) certificates of insurance when participating in traffic and present these documents at request of traffic police and other competent authorities as per the law.
4. Comply with regulations on road traffic safety.
5. In case of traffic accidents, be responsible for:
a) immediately informing insurance enterprises to cooperate in resolving, treating, limiting further damage to health, life and property, and protecting accident scenes; immediately informing the nearest police authorities or local governments to cooperate in resolving the accidents as per the law and cooperate with authorities in investigating and verifying causes of accidents.
b) refraining from moving, dismantling or repairing properties without consensus of insurance enterprises; except for cases in which such activities are necessary to ensure safety, prevent damage to health, life and properties or according to request of competent agencies.
c) collecting and providing documents required under insurance claim dossiers within responsibilities of insurance buyers and insurance beneficiaries for insurance enterprises according to Article 15 of this Decree.
d) enabling insurance enterprises to verify documents by the insurance buyers and insurance beneficiaries.
6. Notify victims or heirs or representatives of the victims about claims paid by insurance enterprises for each case of damage to health and life according to Point a Clause 3 Article 14 of this Article and pay claims.
7. Inform insurance enterprises in writing according to Point a Clause 1 and Point a Clause 3 Article 11 of this Decree.
Thus, according to the above regulations in Vietnam, when participating in traffic, participants must always carry valid insurance (physical or electronic). You can still use the motorbike insurance you bought online, using motorbike insurance online is not against the law.
As long as you save that insurance in your phone in case the traffic police ask to check your documents, you can still give it to the police, avoiding the situation of not having vehicle insurance when participating in traffic. Note that insurance must be valid in Vietnam.

How much is fine for motorbike drivers who do not carry insurance in Vietnam?
According to Clause 2, Article 21 of Decree 100/2019/ND-CP amended by Clause 11, Article 2 of Decree 123/2021/ND-CP, regulating penalties for offences against regulations on qualification for operating motor vehicles as follows:
2. A fine ranging from VND 100,000 to VND 200,000 shall be imposed upon:
a) Any person operating a motorcycle or moped and the like without carrying an unexpired certificate of civil liability insurance for motor vehicles; or
b) Any person operating a motorcycle or moped and the like without carrying the certificate of vehicle registration; or
c) Any person operating a motorcycle and the like without carrying a driver’s license, except for the offences specified in point b clause 5 and point c clause 7 of this Article.
Therefore, when participating in traffic, motorbike drivers who do not carry valid insurance will be fined from 100,000 VND to 200,000 VND in Vietnam.
When an accident occurs in Vietnam, what is insurance buyer's responsibility in Vietnam?
Pursuant to Clause 5, Article 18 of Decree 03/2021/ND-CP, when an accident occurs, the insurance buyer has the following responsibilities:
5. In case of traffic accidents, be responsible for:
a) immediately informing insurance enterprises to cooperate in resolving, treating, limiting further damage to health, life and property, and protecting accident scenes; immediately informing the nearest police authorities or local governments to cooperate in resolving the accidents as per the law and cooperate with authorities in investigating and verifying causes of accidents.
b) refraining from moving, dismantling or repairing properties without consensus of insurance enterprises; except for cases in which such activities are necessary to ensure safety, prevent damage to health, life and properties or according to request of competent agencies.

Above are the responsibilities of the insurance buyer when an accident occurs in Vietnam.
