Is the Contribution Period Retained if Unemployment Benefits Are Not Collected?
Clause 6, Article 18, Decree 28/2015/ND-CP stipulates as follows:
After a period of 03 months from the date the employee's unemployment benefit period ends as per the decision to receive unemployment benefits, but the employee does not come to collect the unemployment benefits and does not notify in writing the social insurance organization where they are receiving the unemployment benefits, the employee is considered as having no need for unemployment benefits. The period corresponding to the unemployment benefit amount that the employee did not come to collect will be reserved as a basis for calculating the period for future unemployment benefits when they meet the eligibility conditions for unemployment benefits as stipulated.
...
According to the information you provided, you received a decision to receive unemployment benefits from March 2020, and as of July 2020, you have not yet collected the unemployment benefits.
=> This means that more than 03 months have passed since receiving the decision to receive unemployment benefits, and you have neither collected the money nor notified the social insurance agency, so you are considered as having no need for unemployment benefits.
Therefore, the period corresponding to the unemployment benefit amount that you did not come to collect will be reserved. This reserved period will be used as a basis to calculate the unemployment benefit period for the next time you meet the eligibility conditions for unemployment benefits according to regulations.
Respectfully!
