Is it possible to withdraw social insurance in one lump sum after contributing for 6 months?
Section 1, Article 8 of Decree 115/2015/ND-CP prescribes lump-sum social insurance as follows:
Workers specified in Clause 1 and Clause 2, Article 2 of this Decree, upon request, will be entitled to lump-sum social insurance if they fall into one of the following cases:
- Eligible for pension age as prescribed in Clauses 1, 2, and 4, Article 54 of the Law on Social Insurance but have not paid social insurance premiums for 20 years; or as prescribed in Clause 3, Article 54 of the Law on Social Insurance but have not paid social insurance premiums for 15 years and do not continue to participate in voluntary social insurance;
- After one year of leaving work, have not paid social insurance premiums for 20 years and do not continue to pay social insurance;
- Moving abroad to settle;
- Suffering from one of the life-threatening diseases such as cancer, polio, ascites cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS, and other diseases as regulated by the Ministry of Health;
Therefore, for a worker to receive lump-sum social insurance, they must fall into one of the above categories. There is no regulation that mandates reaching the retirement age before being eligible to request lump-sum social insurance.
According to your case, if you have been unemployed for more than one year and you do not continue to participate in social insurance, you can proceed with the procedures to receive lump-sum social insurance.
