Is it possible to receive support under Resolution 116 while processing Unemployment Insurance claims?
According to Resolution 116/ND-CP of 2021, which provides for monetary support for workers affected by the COVID-19 pandemic from the surplus of the Unemployment Insurance Fund, the applicable targets include:
- Workers who are participating in unemployment insurance as of September 30, 2021 (excluding workers working in state agencies, political organizations, socio-political organizations, people's armed units, and public service providers whose regular expenses are guaranteed by the state budget).
- Workers who have stopped participating in unemployment insurance due to termination of labor contracts or work contracts between January 1, 2020, and September 30, 2021, with their unemployment insurance contribution time reserved according to the provisions of labor law, excluding those receiving a monthly pension.
In addition, Official Dispatch 3068/BHXH-CSXH of 2021 implementing Decision 28/2021/QD-TTg provides guidance:
In cases where workers have submitted their applications for unemployment insurance benefits but have not received a decision by September 30, 2021, the total time contributing to unemployment insurance, which has not been enjoyed, will be used to determine the support level as of September 30, 2021.
Based on the above regulations, workers who have temporarily stopped due to termination of labor contracts between January 1, 2020, and September 30, 2021, with their unemployment insurance contribution time reserved, are entitled to support.
According to the information provided, you have submitted your unemployment insurance application but have not received a decision before September 30. Therefore, you are still eligible to receive support from the Unemployment Insurance Fund.
Note: The total time contributing to unemployment insurance, which has not been utilized as of September 30, will be used to determine the support level.
Example: You have contributed to unemployment insurance for 36 months and have not received unemployment insurance before (i.e., 36 months are reserved because they have not been utilized). On September 27, you submitted an application to receive unemployment insurance benefits for these 36 months, but by October 4, no decision has been made. Therefore, when applying for support under Resolution 116, the support level will be determined based on these 36 months. Hence, you may receive 2,100,000 VND.
