Infected with Early-Stage HIV: Eligibility for One-Time Social Insurance Payment?
Point d, Clause 1, Article 8 of Decree 115/2015/ND-CP stipulates the conditions for entitlement to a one-time social insurance benefit as follows:
Employees specified in Clause 1 and Clause 2, Article 2 of this Decree, upon request, shall be entitled to a one-time social insurance benefit if they fall into any of the following cases:
Persons suffering from one of the life-threatening diseases such as cancer, paralysis, ascites due to cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to the AIDS stage, and other diseases as specified by the Ministry of Health.
Thus, according to the above regulation, in your case, you have just left your job from the beginning of October 2020 and are in the early stage of HIV, you do not meet the conditions to receive a one-time social insurance benefit.
