Article 66 of the Law on Social Insurance 2014 has regulations on funeral benefits as follows:

1. When the following persons die, the persons who take charge of their funeral are entitled to a lump-sum funeral allowance:

a/ Employees defined in Clause 1, Article 2 of this Law who are paying social insurance premiums or employees who have their period of social insurance premium payment reserved and have paid social insurance premium payment for at least full 12 months;

b/ Employees who die of a occupational accident or an occupational disease or die during treatment due to a occupational accident or an occupational disease;

c/ Persons who are on pension or monthly occupational accident or occupational disease allowance and have ceased working.

2. The funeral allowance must equal 10 times the statutory pay rate of the month when the persons defined in Clause 1 of this Article die.

Thus, if they fall into the above cases, the person taking care of the funeral will receive a lump-sum funeral allowance with the same allowance level (10 times the base salary). Similar to your friend's case, whether she receives pension for fewer years or more years, the level of funeral allowance will not change.

Currently, the base salary implemented under Decree 38/2019/ND-CP is 1,490,000 VND, the lump-sum funeral allowance will be 14,900,000 VND.

Clause 2, Article 70 of the Law on Social Insurance 2014 has regulations on levels of lump-sum survivorship allowance as follows:

2. The lump-sum survivorship allowance for relatives of dead pensioners shall be calculated based on the period of pension enjoyment; if pensioners die within the first 2 months of pension enjoyment, the allowance must equal 48 months’ current pension; if pensioners die in subsequent months, the allowance shall be reduced by half a month’s pension for each additional month of pension enjoyment; the lowest allowance level must equal 3 months’ current pension.

Based on this regulation in Vietnam, your family's lump-sum survivorship allowance can be calculated as follows:

48 months - [(36 months - 2 months) x 0.5] = 31 months of current pension

You base on your husband's current pension to calculate the specific lump-sum survivorship allowance amount.

Does participating in voluntary social insurance just receive only monthly pension in Vietnam?

Question: Besides retirement benefits, what other benefits can voluntary social insurance participants enjoy? Thanks for advice.

Clause 3, Article 3 of the Law on Social Insurance 2014 stipulates:

3. Voluntary social insurance means a form of social insurance organized by the State in which a participant may select a premium rate and a method of premium payment suitable to his/her income and the State supports his/her payment of social insurance premiums for him/her to enjoy retirement and survivorship allowance benefits.

Thus, when participating in voluntary social insurance, participants can enjoy retirement and survivorship allowances if they meet the conditions specified in this Law in Vietnam.

According to this Article, participants in voluntary social insurance can enjoy a monthly pension, can also enjoy lump-sum social insurance for retirement allowance and survivorship allowance in Vietnam.
