In addition to burial expense benefits, under Article 67 of the 2014 Social Insurance Law, the cases entitled to monthly survivors' benefits are as follows:
- Individuals stipulated in Clause 1 and Clause 3, Article 66 of this Law shall be entitled to monthly survivors' benefits for their dependents upon their death if they fall into one of the following categories:
a) Have paid social insurance premiums for 15 years or more but have not received a lump-sum social insurance payment;
b) Are receiving a pension;
c) Die due to a workplace accident or occupational disease;
d) Are receiving monthly workplace accident or occupational disease benefits with a reduction in working capacity of 61% or more.
- Dependents of individuals stipulated in Clause 1 of this Article who are entitled to monthly survivors' benefits include:
...
b) Wives aged 55 years or older or husbands aged 60 years or older; wives under 55 years old or husbands under 60 years old if they have a reduction in working capacity of 81% or more.
According to your statement, since your father was receiving a pension when he died, your mother, if she meets the above-mentioned conditions, will be entitled to a monthly survivors' benefit. The monthly survivors' benefit for each dependent is equal to 50% of the statutory pay rate.
Regarding the pension, your mother will not be entitled to it for three months after your father's death.
Sincerely!
