Answer:
According to the regulations in Clause 4 Article 85 of the Social Insurance Law 2014 stipulates:
- An employee defined at Point a or b, Clause 1, Article 2 of this Law who signs labor contracts with many employers shall only pay social insurance premiums under Clause 1 of this Article for the first-signed labor contract.
Also, according to the guidance in Clause 1 Article 42 Decision 595/QD-BHXH 2017 on the procedures for collection of social insurance contributions and premiums of health insurance, unemployment insurance, occupational accident and occupational disease insurance and issuance of social insurance books and health insurance cards:
1. An employee who signs at least 2 labor contracts with different employers shall pay social insurance contributions and unemployment insurance premiums according to the first labor contract, pay health insurance premiums according to the labor contract with highest salary and pay premiums of occupational accident and occupational disease according to each labor contract.
Therefore, based on the above regulations in Vietnam, in the case where an employee signs labor contracts with two or more companies, that employee is subject to compulsory social insurance participation, and the first company is responsible for compulsory social insurance for the employee.
As for the second company in Vietnam, the employee will have the employer directly pay for compulsory social insurance from his/her salary, the payment level of the second company equals the compulsory social insurance contribution. Health insurance will be based on the labor contract with the highest salary, while premium of occupational accident and occupational disease will be paid according to each labor contract at the 2 companies.

a/ Every month;
b/ Every 3 months;
c/ Every 6 months;
d/ Every 12 months;
dd/ Lump-sum payment for many subsequent years at a level lower than the monthly payment or lump-sum payment for the insufficient years at a level higher than the monthly payment as specified in this Article.
