Are there any conditions under which the social insurance will be reclaimed?Answer:You may request a reissued social insurance book cover if lost. To do this, you need to submit an application to the social insurance agency where you registered your social insurance. Given that you have moved to another province, you may also apply for reissuance at the social insurance agency in your current province of residence. The specific process will follow the guidelines set by the Vietnam Social Insurance Agency.Social insurance books may be reclaimed in cases where:
  1. There have been misstatements or fraud regarding eligibility or amount due.
  2. The individual has not complied with the social insurance regulations.
  3. Other specific circumstances as stipulated by the law on social insurance.
To complete the procedures for closing your social insurance book after ending your contract, you need to obtain a reissued book cover. Ensure that you provide accurate information and comply with the required provisions to avoid any issues related to reclaiming social insurance.For detailed procedures, it is advisable to directly contact the local social insurance agency.

How to Reissue a Lost Social Insurance Book?

Based on Clause 31 Article 1 of Decision 505/QD-BHXH 2020 regarding the reissuance, replacement, and adjustment of contents on Social Insurance Books and Health Insurance Cards as follows:

  1. Reissuance of Social Insurance Books due to loss, damage, or consolidation of Social Insurance Books

1.1. Document components:

a) Reissuance of Social Insurance Books due to loss or damage: Declaration form for participation, adjustment of Social Insurance and Health Insurance information (Form TK1-TS).

b) Consolidation of Social Insurance Books:

- Declaration form for participation, adjustment of Social Insurance and Health Insurance information (Form TK1-TS).

- The Social Insurance Books requested for consolidation (if any).

1.2. Number of document sets: 01 set.

Additionally, Article 29 of Decision 595/QD-BHXH 2017 also stipulates the issuance of Social Insurance Books as follows:

  1. New issuance: For those participating in compulsory Social Insurance or voluntary Social Insurance: no more than 05 days from the date of receipt of complete documents as prescribed.

  2. Reissuance of Social Insurance Books due to changes in name, first name, middle name; date, month, year of birth; gender, ethnicity; nationality; or Social Insurance Books due to loss or damage; combining service periods without additional Social Insurance contributions or consolidation of Social Insurance Books: no more than 10 days from the date of receipt of complete documents as prescribed. In cases requiring verification of Social Insurance contribution periods in other provinces or at multiple units where the employee had worked, it should not exceed 45 days, with a written notification to the employee.

  3. Adjustment of contents recorded in the Social Insurance Book: no more than 05 days from the date of receipt of complete documents as prescribed.

  4. Verification of the Social Insurance Book: no more than 05 days from the date of receipt of complete documents as prescribed.

Thus, according to current regulations, to reissue a Social Insurance Book, you need to prepare the documents as specified above. Additionally, the processing time is 10 days from the date of receipt of complete documents, in cases requiring Social Insurance contribution verification in another province, you will receive notification but it should not exceed 45 days.

Cases of Social Insurance Collection

Cases of collection of Social Insurance, Health Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance are stipulated in Article 25 of Decision 595/QD-BHXH 2017 as follows:

  1. Suspension of contributions to the retirement and survivorship fund: no more than 05 days from the date of receipt of complete documents as prescribed.

  2. Recovery of arrears

2.1. In cases of violations of legal provisions on contributions to Social Insurance, Health Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance: no more than 10 days from the date of receipt of complete documents as prescribed.

2.2. In cases of adjustment to increase wages which Social Insurance, Health Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance contributions were based on: no more than 03 days from the date of receipt of complete documents as prescribed.

  1. Refunds

3.1. For individuals participating in voluntary Social Insurance, individuals participating in household Health Insurance, and individuals partially funded by the state budget for Health Insurance contributions: no more than 05 days from the date of receipt of complete documents as prescribed.

3.2. For individuals participating in Social Insurance, Health Insurance, Unemployment Insurance, Occupational Accident and Disease Insurance: no more than 10 days from the date of receipt of complete documents as prescribed.

*** An employee's Social Insurance is only collected in the cases stipulated above. In contrast, according to your situation, you are not subject to the collection of Social Insurance.***
