Who are the persons eligible for health insurance regarding the group whose insurance are paid by the employers and employees in Vietnam?

Pursuant to Clause 1 Article 12 of the Law on Health Insurance in 2008 (amended by Clause 6 Article 1 of the Law on amendments to the Law on Health Insurance in 2014) stipulating persons eligible for health insurance as follows:

Persons eligible for health insurance

1. The group whose insurance are paid by the employers and employees, including:

a) Employees on indefinite or at least full three-month contracts; salaried business managers; officials and civil servants (hereinafter referred to as employees).

b) Part-time officers in communes, wards and towns under the regulations of the law.

As regulations above, the persons eligible for health insurance regarding the group whose insurance are paid by the employers and employees in Vietnam includes following entities:

- Employees working under contracts:

+ Employees on indefinite contracts;

+ Employees on at least full three-month contracts;

- Salaried business managers

- Officials and civil servants

- Part-time officers in communes, wards and towns under the regulations of the law.

How much does the employer pay for employee's health insurance in Vietnam?

Pursuant to Clause 1.a Article 7 of the Decree 146/2018/NĐ-CP stipulating health insurance contribution rates and health insurance contribution responsibilities as follows:

Health insurance contribution rates and health insurance contribution responsibilities

1. Monthly health insurance contribution rates shall be subject to the following regulations:

a) The contribution rate shall be equal to 4.5% of the employee’s monthly pay with respect to those policyholders specified in clause 1, Article 1 of this Decree.

- Employees on sick leaves from at least 14 days per a month in accordance with laws on social insurance shall not be required to pay health insurance contributions and shall be entitled to health insurance benefits;

- With respect to employees that are detained, held in custody or suspended from work for investigations, consideration of judgement whether they have committed violations against laws, the monthly contribution rate shall be defined as 4.5% of 50% of each employee's monthly pay. In case where a competent authority makes its judgement that none of violations has been committed, the employee shall be required to pay health insurance contributions in proportion to the accrued pay amount that he/she has received;

As regulations above, the employer's contribution to health insurance for employees is 4.5% of the employee's monthly salary.

Translation:

Accordingly, the employer's contribution to health insurance for employees is 4.5% of the employee's monthly salary.

Note: Employees who are on sick leave for 14 days or more in a month are not required to pay health insurance premiums, but they still enjoy the benefits of health insurance.

- Employees who are temporarily detained, arrested, or suspended from work for investigation or to consider whether or not they have violated the law, the monthly contribution is equal to 4.5% of 50% of the employee's monthly salary.

In the case where the competent authority concludes that there is no violation of the law, the employee must pay back the health insurance premium on the amount of salary that is recovered.

What information are included in the health insurance card issued by competent social insurance agencies in Vietnam?

Pursuant to Article 12 of the Decree 146/2018/NĐ-CP, health insurance cards shall be issued by competent social insurance agencies and contain the following information:

1. Personal information of a policyholder, including:

- Full name

- Gender

- Date of birth

- Permanent residence or workplace address.

2. Health insurance coverage rate stipulated in Article 14 of the Decree 146/2018/NĐ-CP.

3. Start date of a health insurance card.

4. Name of the primary healthcare establishment.

5. The consecutive 5-year or longer period of health insurance participation of policyholders making co-payment of healthcare costs.

6. Photo of the policyholder (not applicable to children under 6 years of age) in case where he/she does not have any photo personal identification document issued by competent bodies or authorities;

Any certificate issued by commune-level police authorities or other documents endorsed by educational institutions or vocational education establishments in charge of management of pupils or students, or other legitimate personal identity documents.
