How many days of leave is the husband entitled to if the wife has a cesarean section?
According to Clause 2, Article 34 of the Social Insurance Law 2014, the regulation is as follows:
- Male employees who are currently paying social insurance and whose wives give birth shall be entitled to maternity leave benefits as follows:
a) 05 working days;
b) 07 working days when the wife gives birth via surgery or the child is born before 32 weeks gestation;
c) In the case of twins, the male employee is entitled to 10 working days; for triplets or more, an additional 03 working days for each additional child;
d) In the case of twins or more, where the wife gives birth via surgery, the male employee is entitled to 14 working days.
The maternity leave benefits prescribed in this clause shall be taken within 30 days from the date the wife gives birth.
Thus, in the case of male employees whose wives give birth via surgery, they shall be entitled to 07 working days off.
