How long must a vehicle insurance claim be submitted to the insurer?
In Article 16 of Decree 03/2021/ND-CP on compulsory civil liability insurance of motor vehicle owners, it is stipulated:
- The time limit for claiming compensation is 1 year from the date of the accident, except for delays due to objective and force majeure reasons as prescribed by law.
- Within 5 working days from the date of the accident (except for force majeure cases), the policyholder and the insured must send a written accident notification or electronically to the insurer.
- The time limit for the insurer to pay compensation is 15 days from the date of receiving a complete and valid insurance claim file and not more than 30 days from the date of receiving a complete and valid insurance claim file in case of needing to verify the file.
- In case of refusing to compensate, the insurer must notify in writing to the policyholder and the insured the reason for refusal within 30 days from the date of receiving a complete and valid insurance claim file.
=> Therefore, according to the above regulations, the time limit to send the file to the insurer from the time of the accident is 5 working days from the date of the accident (except for force majeure cases).
