From July 1, 2025, will employees working under labor contracts of one month or more in Vietnam be subject to mandatory health insurance participation?

Pursuant to Article 12 of the Law on Health Insurance 2008 (amended by Clause 10, Article 1 of the Amended Law on Health Insurance 2024) on the subjects participating in health insurance:

Article 12. Subjects participating in health insurance

  1. Groups whose contributions are paid by employers or employees or jointly include:

a) Employees working under labor contracts with indefinite terms, fixed-term contracts with a duration of at least 01 month, including cases where employees and employers agree with other names but the content demonstrates employment with wages, salary, and management, operation, and supervision by one party; managers of enterprises, controllers, representatives of the state's capital portion, representatives of businesses’ capital contributions as prescribed by law; members of the Board of Directors, General Director, Director, members of the Supervisory Board, or controllers and other elected management titles of cooperatives, unions of cooperatives under the Cooperative Law with a salary;

b) Managers of enterprises, controllers, representatives of the state's capital portion, representatives of business's capital contributions as prescribed by law; members of the Board of Directors, General Director, Director, members of the Supervisory Board, or controllers and other elected management titles of cooperatives, unions of cooperatives under the Cooperative Law without a salary;

c) Foreign employees working in Vietnam under labor contracts with a duration of at least 12 months with employers in Vietnam, except for those who are internal transfers within enterprises as prescribed by the law on foreign employees working in Vietnam or at the time of concluding the labor contract have reached the retirement age as prescribed in Clause 2, Article 169 of the Labor Code or an international treaty to which the Socialist Republic of Vietnam is a member has different provisions;

d) Employees working under indefinite term labor contracts, fixed-term labor contracts with a duration of at least 01 month, including cases where employees and employers agree with other names but the content demonstrates employment with wages, salary, and management, operation, and supervision by one party, agreed with employer for part-time work, having monthly wages equal to or higher than the lowest wages used as a basis for mandatory social insurance under the law on social insurance;

Based on the above provision, from July 1, 2025, employees working under fixed-term labor contracts with a duration of at least 01 month, including cases where employees and employers agree with different names but the content demonstrates employment with wages, salary, and management, operation, and supervision by one party.

What is the health insurance premium for employees working under labor contracts for 1 month or more in Vietnam?

Pursuant to Article 13 of the Law on Health Insurance 2008 (amended by Clause 11, Article 1 of the Amended Law on Health Insurance 2024) on the premium rate and responsibility for health insurance contributions:

Article 13. Premium rate and responsibility for health insurance contributions

  1. The contribution rate by employers or employees or jointly is stipulated as follows:

a) The monthly contribution rate for the subjects specified in points a, c, d, and e of Clause 1 Article 12 of this Law is up to 6% of the monthly wages, in which the employer pays two-thirds and the employee pays one-third;

b) The monthly contribution rate for the subject specified in point b Clause 1 Article 12 of this Law is up to 6% of the monthly wages as the basis for mandatory social insurance contributions and is paid by the subject;

c) The monthly contribution rate for the subject specified in point đ Clause 1 Article 12 of this Law is up to 6% of the monthly wages as the basis for mandatory social insurance contributions and is paid by the subject;

According to the above provision, employees working under fixed-term labor contracts with a duration of at least 01 month have a maximum monthly health insurance contribution rate of 6% of the monthly wages, with the employer paying two-thirds and the employee paying one-third.

In what cases is the health insurance card in Vietnam revoked?

Pursuant to Article 20 of the Law on Health Insurance 2008 (supplemented by Clause 13, Article 1 of the Amended Law on Health Insurance 2024) on the revocation and temporary retention of health insurance cards:

Article 20. Revocation and temporary retention of health insurance cards

  1. The health insurance card is revoked in the following cases:

a) Fraud in the issuance of the health insurance card;

b) The person named on the health insurance card no longer participates in health insurance.

c) Duplicate issue of the health insurance card.

  1. The health insurance card is temporarily retained when a person visits a doctor or receives medical treatment using another person's health insurance card. The person whose health insurance card is temporarily retained is responsible for collecting the card and paying fines as prescribed by law.

Thus, the health insurance card is revoked in the following cases:

- Fraud in the issuance of the health insurance card

- The person named on the health insurance card no longer participates in health insurance

- Duplicate issue of the health insurance card
