From July 1, 2025, how long is the sick leave policy for employees?
Based on Article 43 of the Social Insurance Law 2024 which stipulates the duration of sick leave policy:
Article 43. Duration of sick leave policy
- The maximum duration of sick leave policy in a year (from January 1 to December 31) for the subjects specified in points a, b, c, i, k, l, m, and n of Clause 1 and Clause 2 of Article 2 of this Law is calculated based on working days, excluding holidays, Tet, weekends, and is as follows:
a) Working under normal conditions is entitled to 30 days if social insurance premiums have been paid for less than 15 years; 40 days if 15 years to less than 30 years; 60 days if 30 years or more;
b) Engaging in heavy, hazardous, dangerous jobs or especially heavy, hazardous, dangerous jobs as specified by the Minister of Labor, Invalids and Social Affairs, or working in areas with particularly difficult socioeconomic conditions are entitled to 40 days if social insurance premiums have been paid for less than 15 years; 50 days if 15 years to less than 30 years; 70 days if 30 years or more.
- After the sick leave period specified in Clause 1 of this Article, if the treatment continues, the employee suffering from a disease listed by the Ministry of Health that requires long-term treatment will continue to be entitled to the sick leave policy in accordance with Clause 3 of Article 45 of this Law. The sick leave period specified in this clause is calculated based on working days, excluding holidays, Tet, and weekends.
- The sick leave period for the subjects specified in point d of Clause 1 of Article 2 of this Law is based on the inpatient treatment period at the medical examination and treatment facility and the time off work as prescribed by the medical practitioner at the medical examination and treatment facility.
Therefore, from July 1, 2025, the sick leave duration for employees is stipulated as follows:
[1] Employees working under normal conditions are entitled to:
- 30 days if mandatory social insurance premiums have been paid for less than 15 years- 40 days if paid for 15 years to less than 30 years- 60 days if paid for 30 years or more
[2] For those engaged in heavy, hazardous, dangerous jobs or especially heavy, hazardous, dangerous jobs as specified by the Minister of Labor, Invalids and Social Affairs, or working in areas with particularly difficult socioeconomic conditions, the entitlement is:
- 40 days if mandatory social insurance premiums have been paid for less than 15 years- 50 days if paid for 15 years to less than 30 years- 70 days if paid for 30 years or more
Note: The sick leave period is calculated based on working days, excluding holidays, Tet, weekends.
For officers, professional soldiers of the People's Army; officers, non-commissioned officers of the professional technical police force; individuals working in cryptographic work with salaries like military personnel, the sick leave period is based on the inpatient treatment period at the medical examination and treatment facility and the time off work as prescribed by the medical practitioner at the medical examination and treatment facility.

From July 1, 2025, what are the subjects and conditions for enjoying the sick leave policy?
Based on Article 42 of the Social Insurance Law 2024 which stipulates the subjects and conditions for enjoying the sick leave policy as follows:
[1] Subjects eligible for sick leave policy:
- Individuals working under indefinite-term labor contracts, definite-term labor contracts for a period of 01 month or more, including cases where the labor contract and employer-employee agreement use other terms but imply paid work under management, direction, and supervision of one party
- Officials and public employees
- Defense workers and public employees, police workers, individuals engaged in other work in the cryptographic organization
- Officers, professional soldiers of the People's Army; officers, non-commissioned officers of the professional technical police force; individuals working in cryptographic work with salaries like military personnel
- Business managers, supervisors, state capital representatives, enterprise capital representatives as regulated by law; members of the Board of Directors, General Director, Director, members of the Supervisory Board or supervisors, and other elected management officers of cooperatives, cooperative unions per the Cooperative Law with salaries
- Non-specialized personnel at commune, district, town, and city levels
- Employees working under part-time labor contracts with monthly salaries equal to or higher than the minimum salary used to calculate mandatory social insurance premiums
- Business household owners with registered business participation as per the Government's regulations
- Foreign workers in Vietnam eligible for mandatory social insurance when working under definite-term labor contracts for 12 months or more with employers in Vietnam, except the following cases:
+ Internal company transfers following the legal regulations on foreign workers in Vietnam
+ Reaching retirement age at the time of signing the labor contract
+ International treaties to which the Socialist Republic of Vietnam is a party with different provisions.
[2] Cases eligible for sick leave policy:
- Treatment for diseases other than occupational diseases
- Treatment for accidents other than occupational accidents
- Treatment for accidents occurring en route from home to work or return along a reasonable route and time as per laws on occupational safety and hygiene
- Treatment, rehabilitation for injuries, disease recurrence due to occupational accidents, occupational diseases, or accidents en route from home to work or return along a reasonable route and time as per laws on occupational safety and hygiene
- Donating, receiving, or transplanting human tissues or organs as prescribed by law
- Taking care of a child under 07 years old who is sick
On what basis is the sick leave allowance calculated?
Based on Article 45 of the Social Insurance Law 2024 the sick leave allowance is calculated monthly based on the following:
- The monthly salary used as the basis for social insurance contributions of the nearest month before the month of taking sick leave policy- The monthly salary used as the basis for social insurance contributions of the first participating month or the month of return if resuming participation after taking sick leave policy in the first resumed month
Note: Social Insurance Law 2024 takes effect from July 1, 2025.
