According to According to Article 95 of the Law on Social Insurance 2024 that stipulates maternity benefits:

Article 95. Maternity Benefits

1. The maternity benefit is 2,000,000 VND for each child born and for each fetus from 22 weeks of pregnancy that dies in the womb, or that dies during labor.

Female employees who are ethnic minorities or female employees who are ethnic Kinh people with husbands who are ethnic minorities belonging to poor households, when giving birth, are entitled to other support policies as prescribed by the Government of Vietnam.

2. The state budget ensures the implementation of the provisions in Clause 1 of this Article. The Government of Vietnam decides to adjust the maternity benefit level appropriate to the socioeconomic development conditions and the capability of the state budget in each period.

According to the above regulation in Vietnam, employees participating in voluntary social insurance receive a maternity benefit of 2,000,000 VND for each child born and for each fetus from 22 weeks of pregnancy that dies in the womb, or that dies during labor.

Female employees who are ethnic minorities or female employees who are ethnic Kinh people with husbands who are ethnic minorities belonging to poor households, when giving birth, are entitled to other support policies as prescribed by the Government of Vietnam.

When will voluntary social insurance participants entitled to maternity benefit submit their application?

According to Article 97 of the Law on Social Insurance 2024 that stipulates the provision of maternity benefits in Vietnam:

Article 97. Provision of maternity benefits

  1. Within 60 days from the date of childbirth, employees are responsible for submitting the documents stipulated in Article 96 of this Law to the social insurance agency.
  1. Within 5 working days from the receipt of complete documents, the social insurance agency is responsible for resolving the claim. If not resolved, they must respond in writing and clearly state the reasons.

According to the above regulation, participants in voluntary social insurance should submit their documents for maternity benefits within 60 days from the date of childbirth.

Article 96 of the Law on Social Insurance 2024 stipulates the documents needed to claim maternity benefits when participating in voluntary social insurance, which includes one of the following papers:

[1] A copy of the birth certificate or birth extract, or a copy of the birth notification of the child

[2] In the case of a fetus death in the womb, during labor, or if the child dies after birth but has not received a birth notification, the documents include one of the following:

- The original or a copy of the summarized medical record showing the child's death

- The original or a copy of the hospital discharge paper of the female employee giving birth showing the child's death

- A copy of the child's death certificate

- A written confirmation from the communal People's Committee if the child dies within 24 hours of birth

If both parents participate in voluntary social insurance, who will receive the maternity benefit?

According to Article 94 of the Law on Social Insurance 2024 that stipulates beneficiaries and eligibility for maternity benefits in Vietnam:

Article 94. Beneficiaries and eligibility for maternity benefits

1. Individuals who have contributed to voluntary social insurance, or both compulsory and voluntary social insurance for at least 6 months within the last 12 months before childbirth, are entitled to maternity benefits under one of the following cases:

a) Female employees giving birth;

b) Male employees with wives giving birth.

2. If only the mother participates in social insurance and the mother dies after childbirth, the father or the direct caretaker will receive the maternity benefit.

3. If both the father and the mother participate in social insurance and both meet the conditions for maternity benefits as stipulated in Clause 1 of this Article, only either the father or the mother receives the maternity benefit.

4. If an individual specified in Clause 1 of this Article is eligible for maternity benefits under both voluntary and compulsory social insurance, they will only receive maternity benefits from the compulsory social insurance.

5. If the mother is eligible for maternity benefits under compulsory social insurance and the father is eligible under voluntary social insurance, the mother will receive maternity benefits under compulsory social insurance and the father will receive benefits under voluntary social insurance.

6. If the father is eligible for maternity benefits under compulsory social insurance and the mother is eligible under voluntary social insurance, the father will receive maternity benefits under compulsory social insurance and the mother will receive benefits under voluntary social insurance.

According to the above regulation, if both parents participate in voluntary social insurance, only one of them, either the father or the mother, will receive the maternity benefit.

* The Law on Social Insurance 2024 takes effect in Vietnam from July 1, 2025.
