From July 1, 2025, what are the conditions for maternity benefits when participating in voluntary social insurance?
Based on Article 94 of the 2024 Social Insurance Law which stipulates subjects and conditions for maternity benefits:
Article 94. Subjects and conditions for maternity benefits
- Subjects who have paid voluntary social insurance or have both compulsory social insurance and voluntary social insurance contributions for at least 6 months within the 12 months prior to childbirth are entitled to maternity benefits in the following cases:
a) Female workers giving birth;
b) Male workers whose wives give birth.
- If only the mother participates in social insurance and the mother dies after childbirth, the father or the direct caregiver is entitled to maternity benefits.
- If both father and mother participate in social insurance and qualify for maternity benefits as prescribed in Clause 1 of this Article, only either the father or the mother will receive the maternity benefits.
- If the person specified in Clause 1 of this Article is eligible for maternity benefits in both voluntary social insurance and compulsory social insurance, they will only receive maternity benefits from compulsory social insurance.
- If the mother is eligible for maternity benefits under compulsory social insurance and the father is eligible for maternity benefits under voluntary social insurance, the mother will receive maternity benefits under compulsory social insurance and the father will receive maternity benefits under voluntary social insurance.
- If the father is eligible for maternity benefits under compulsory social insurance and the mother is eligible for maternity benefits under voluntary social insurance, the father will receive maternity benefits under compulsory social insurance and the mother will receive maternity benefits under voluntary social insurance.
Thus, the conditions for maternity benefits when participating in voluntary social insurance are as follows:
[1] Having paid voluntary social insurance or having both compulsory and voluntary social insurance contributions for at least 6 months within the 12 months prior to childbirth
[2] Belonging to one of the following cases:
- Female workers giving birth- Male workers whose wives give birth

What is the amount of maternity benefits when participating in voluntary social insurance?
Based on Article 95 of the 2024 Social Insurance Law which stipulates maternity benefits:
Article 95. Maternity benefits
- The amount of maternity benefits is VND 2,000,000 for each child born and each fetus of 22 weeks or more that dies in utero, or for fetuses that die during labor.
Female workers who are ethnic minorities or female workers who are Kinh ethnicity with husbands who are ethnic minorities belonging to poor households are also entitled to other support policies as prescribed by the Government of Vietnam.
- The state budget shall ensure the implementation of the provisions in Clause 1 of this Article. The Government of Vietnam shall decide to adjust the maternity benefit amount in accordance with the socio-economic development conditions and the state budget's capacity in each period.
Thus, the amount of maternity benefits when participating in voluntary social insurance is VND 2,000,000 for each child born and each fetus of 22 weeks or more that dies in utero, or for fetuses that die during labor.
What documents are required to apply for maternity benefits when participating in voluntary social insurance?
Based on Article 96 of the 2024 Social Insurance Law which stipulates the documents required to apply for maternity benefits, the dossier includes one of the following documents:
[1] A copy of the birth certificate or an extract of the birth certificate or a copy of the child's birth certificate
[2] In the case of a fetus dying in utero, a fetus dying during labor, or a child dying after birth without obtaining a birth certificate, the dossier includes one of the following documents:
- The original or a copy of the abbreviated medical record showing the child's death- The original or a copy of the hospital discharge paper of the female worker showing the child's death- A copy of the child's death certificate- A confirmation document from the Commune People's Committee in the case of the child dying within 24 hours of birth
* The 2024 Social Insurance Law takes effect from July 1, 2025.
