From July 1, 2025, how long do voluntary social insurance contributions need to be paid to receive maternity benefits?
Based on Article 94 of the 2024 Law on Social Insurance, which stipulates the subjects and conditions for receiving maternity benefits:
Subjects and Conditions for Receiving Maternity Benefits
- Individuals who have paid voluntary social insurance or have a combined period of mandatory and voluntary social insurance contributions for at least 6 months within 12 months prior to childbirth are entitled to maternity benefits under one of the following circumstances:
a) Female employees giving birth;
b) Male employees whose wives give birth.
In cases where only the mother participates in social insurance and the mother dies after childbirth, the father or the person directly taking care of the child is entitled to maternity benefits.
In cases where both the father and mother participate in social insurance and are eligible for maternity benefits as stipulated in Clause 1 of this Article, only one parent (either the father or the mother) is entitled to maternity benefits.

Who is eligible to participate in voluntary social insurance?
Based on Clause 4, Article 2 of the 2024 Law on Social Insurance, which stipulates the subjects participating in mandatory and voluntary social insurance:

- Subjects eligible to participate in voluntary social insurance include:
a) Vietnamese citizens aged 15 years and older, not falling under the category required to participate in mandatory social insurance and not receiving pensions, social insurance benefits, or monthly allowances;
b) Subjects stipulated in points a and b, Clause 1 of this Article, temporarily suspending the implementation of labor contracts, work contracts, except where both parties agree on mandatory social insurance contributions during this period.

Thus, the subjects eligible to participate in voluntary social insurance include:
- Vietnamese citizens aged 15 years and older who do not fall under the category of mandatory social insurance participants and are not receiving pensions, social insurance benefits, or monthly allowances.
- Subjects temporarily suspending the implementation of labor contracts, work contracts, except where both parties agree on mandatory social insurance contributions during this period:
+ Individuals working under indefinite-term labor contracts, definite-term labor contracts of at least 1 month, including cases where the labor contract and the employer agree under different titles but are paid and managed, supervised by one party.
+ Officials and public employees.
What is the maternity benefit level for participants in voluntary social insurance?
Based on Article 95 of the 2024 Law on Social Insurance, which stipulates maternity benefits:
Maternity Benefit
- The level of maternity benefit is 2,000,000 VND for each child born and each fetus that is 22 weeks or older that dies in the womb, or a fetus that dies during labor.
Female employees who are ethnic minorities or female employees who are ethnic Kinh with husbands who are ethnic minorities from poor households are also entitled to additional support policies as stipulated by the Government of Vietnam.
- The state budget ensures the implementation of provisions in Clause 1 of this Article. The Government of Vietnam decides on the adjustment of maternity benefit levels in line with economic and social development conditions and the state budget's capacity from time to time.
Thus, the maternity benefit level for participants in voluntary social insurance is 2,000,000 VND for each child born and each fetus that is 22 weeks or older that dies in the womb, or a fetus that dies during labor.
In cases where the female employee is an ethnic minority or a female employee who is ethnic Kinh with a husband who is an ethnic minority from poor households, they are also entitled to additional support policies as stipulated by the Government of Vietnam.
