Expected: 09 beneficiaries will have their pension increased by 15% starting from July 1, 2024 in Vietnam
The draft Decree on adjusting pensions, social insurance benefits, and monthly allowances is expected to take effect from July 1, 2024, replacing Decree 42/2023/ND-CP.
According to Article 1 of the draft Decree, it is anticipated that 09 beneficiaries will have their pensions increased by 15% from July 1, 2024. These beneficiaries include:
(1) Officials, civil servants, workers, employees, and laborers (including those who voluntarily participate in social insurance, those who retire from the Nghệ An Farmers' Social Insurance Fund according to Decision 41/2009/QD-TTg, military personnel, public security officers, and personnel serving in essential positions who are currently receiving monthly pensions.
(2) Communal, ward, town officials as regulated in Decree 33/2023/ND-CP, Decree 92/2009/ND-CP, Decree 34/2019/ND-CP, Decree 121/2003/ND-CP, and Decree 09/1998/ND-CP.
(3) Individuals receiving monthly labor capacity loss allowances according to the law; individuals receiving monthly allowances according to Decision 91/2000/QD-TTg, Decision 613/QD-TTg in 2010; rubber workers receiving monthly allowances according to Decision 206-CP in 1979.
(4) Communal, ward, town officials currently receiving monthly allowances according to Decision 130-CP in 1975 and Decision 111-HDBT in 1981.
(5) Military personnel receiving monthly allowances according to Decision 142/2008/QD-TTg.
(6) Public security officers receiving monthly allowances according to Decision 53/2010/QD-TTg.
(7) Military personnel, public security officers, personnel serving in essential positions receiving allowances like military personnel and public security officers, according to Decision 62/2011/QD-TTg.
(8) Individuals receiving monthly work accident and occupational disease allowances.
(9) Individuals receiving monthly disability allowances before January 1, 1995.
Note: The beneficiaries mentioned in (1), (2), (3), (4), (5), (6), and (7) who retired and are receiving pensions, social insurance benefits, and monthly allowances before January 1, 1995, will have their pensions, social insurance benefits, and monthly allowances adjusted to be below 3.5 million VND/month, as regulated in Clause 1, Article 2 of the draft Decree.

Does illegal emigration result in the suspension of pension benefits in Vietnam?
According to Clause 1, Article 64 of the 2014 Social Insurance Law, the provision states the following:
Suspension and resumption of monthly pension benefits:
1. Individuals receiving monthly pension benefits may have their benefits temporarily suspended and resumed in the following cases:
a) Illegal emigration;
b) Being declared missing by a court;
c) There is evidence to determine that the receipt of social insurance benefits does not comply with legal regulations.
2. Monthly pension benefits will be resumed when the individual returns and settles legally according to the regulations on residence. In the case where a court decision nullifies the declaration of being missing, in addition to continuing to receive pension benefits, the individual is entitled to retroactive payment of the suspended pension benefits from the date of suspension.
3. The social insurance agency, when deciding to suspend benefits according to the provisions in this clause, must notify the individual in writing and state the reasons clearly. Within 30 days from the date of suspension, the social insurance agency must make a decision to resolve the benefit issue. In the case of a decision to terminate social insurance benefits, the reasons must be clearly stated.
As regulated above, individuals receiving pension benefits may have their benefits temporarily suspended if they engage in illegal emigration.
