Entitlement to Sick Leave Policies for Concurrent Illness of Two Children
[Your Name]
Based on Clause 1, Article 27 of the 2014 Social Insurance Law stipulating the duration of leave policies when a child is sick
The duration of leave policies when a child is sick in a year for each child is calculated by the number of days taking care of the child, with a maximum of 20 working days if the child is under 3 years old; a maximum of 15 working days if the child is from 3 years to under 7 years old.
Point a, Clause 1, Article 5 of Circular No. 59/2015/TT-BLDTBXH of the Ministry of Labor, Invalids and Social Affairs detailing and guiding the implementation of some articles of the Social Insurance Law on compulsory social insurance stipulates the duration of leave policies when having 2 or more children sick at the same time as follows:
- The maximum duration of leave policies when a child is sick in a year for each child stipulated in Clause 1, Article 27 of the Social Insurance Law is calculated by the working days, not counting public holidays, Tet holidays, and weekly leaves according to regulations. This duration is counted from January 1 to December 31 of the calendar year, regardless of the starting time of the employee's participation in social insurance.
a) In case an employee has 2 or more children under 7 years old getting sick at the same time, the duration of leave policies when a child is sick is calculated by the actual time the employee takes leave taking care of the sick child; the maximum duration of employee leave in a year for each child is implemented according to the stipulation in Clause 1, Article 27 of the Social Insurance Law.
Based on the above grounds, the duration of leave policies when your child is sick is calculated by the actual time you have taken care of your child, in case of both your children but not exceeding 30 working days.
This duration does not include public holidays, Tet holidays, and weekly leaves.
Sincerely!
