Entitled to 10 Days Off Due to Miscarriage, How Much Insurance Payout Will Be Received?
The duration of benefits for miscarriage is stipulated in Clause 1, Article 33 of the Social Insurance Law 2014:
- In the event of miscarriage, abortion, curettage, stillbirth, or pathological abortion, female workers are entitled to maternity benefits according to the prescription of the competent medical facility. The maximum duration of leave is regulated as follows:
a) 10 days if the fetus is less than 05 weeks old;
b) 20 days if the fetus is from 05 weeks to less than 13 weeks old;
c) 40 days if the fetus is from 13 weeks to less than 25 weeks old;
d) 50 days if the fetus is 25 weeks old or older.
Level of maternity benefits (Article 39):
Employees eligible for maternity benefits as prescribed in Articles 32, 33, 34, 35, 36, and 37 of this Law shall receive the following benefits:
The monthly benefit amounts to 100% of the average monthly salary on which social insurance premiums are based, for the 6 months preceding the leave for maternity benefits. If the employee has not paid the social insurance premiums for a full 6 months, the maternity benefits as prescribed in Article 32, Article 33, Clauses 2, 4, 5, and 6 of Article 34, and Article 37 of this Law shall be the average monthly salary of the months during which social insurance premiums have been paid.

The benefits for childbirth or adoption are calculated based on the monthly allowance as specified in point a, clause 1 of this Article. In cases of odd days or as prescribed in Article 33 and Article 37 of this Law, the daily benefit is calculated by dividing the monthly allowance by 30 days.
To be specific: Amount to be received:
Benefit Amount = (Mbq6t: 30 days) x 100% x Number of leave days
Where: Mbq6t: Average monthly salary on which social insurance premiums were paid for 6 consecutive months prior to the leave.
If the premium payment period is less than 6 months, the average monthly salary is calculated based on the number of months the premiums were paid.
Thus, in this case, the insurance amount she is entitled to is: (6,000,000: 30) x 100% x 10 = 2,000,000 VND.
