Does the Convalescence Period after a Miscarriage Include Weekends?
According to Article 33 of the Social Insurance Law 2014, female employees who have a miscarriage are entitled to maternity leave as prescribed by an authorized medical examination and treatment facility.
Clause 1 of Article 41 of the Social Insurance Law 2014 stipulates the following regarding rest and health recovery after maternity leave:
- Immediately after the period of maternity leave specified in Article 33, Clause 1, or Clause 3 of this Law, if the female employee's health has not yet recovered within the first 30 working days, she is entitled to rest and health recovery from 5 to 10 days.
- The rest and health recovery period includes public holidays, Lunar New Year holidays, and weekly rest days. If the rest and health recovery period spans from the end of the previous year to the beginning of the following year, the rest period is counted for the previous year.
Therefore, the period of rest and health recovery after a miscarriage includes weekend days. The 2 days of Saturday and Sunday (weekend days as per company regulations) will still be paid by the social insurance.
