Does Paternity Leave for Male Employees Include Sundays?
According to Clause 2a, Article 34 of the Law on Social Insurance 2014, male employees who are paying social insurance premiums are entitled to 05 working days of paternity leave when their wives give birth.
The period of paternity leave specified in this clause shall be calculated within the first 30 days from the date the wife gives birth.
Clause 7, Article 34 of the Law on Social Insurance 2014 stipulates: The period of enjoying maternity policies specified in Clauses 1, 3, 4, 5, and 6 of this Article includes public holidays, New Year's holidays, and weekly rest days.
Meanwhile, the case of male employees taking paternity leave falls under Clause 2, Article 34 of the Law on Social Insurance 2014.
Therefore, the paternity leave of male employees does not include Sunday (if this is the weekly rest day).
