Does maternity leave be calculated as period of social insurance premium payment in Vietnam?
Clause 2, Article 39 of the Law on Social Insurance 2014 stipulates:
The period of leave to enjoy maternity benefits of 14 working days or more in a month is considered as the time of contributing to social insurance. The employee and the employer are not required to contribute to social insurance during this period.
Additionally, Clause 6, Article 42 of Decision 595/QD-BHXH of 2017 also stipulates:
Employees on maternity leave of 14 working days or more in a month are not required to contribute to social insurance, unemployment insurance, occupational accident and disease insurance. This time is considered as the time of contribution to social insurance, is not considered as the time of contribution to unemployment insurance, and the social insurance agency will cover the health insurance for the employees.
Thus, the period you take maternity leave is still considered as the time of social insurance contribution.
