Convalescence Leave of 09 Days: How Much Allowance is Offered?
According to Article 29 of the Law on Social Insurance 2014 regarding convalescence and health rehabilitation after sickness, it is stipulated as follows:
- Employees who have taken leave to enjoy sickness benefits for the entire duration in a year as stipulated in Article 26 of this Law, within the first 30 days of returning to work but whose health has not yet recovered, are entitled to a convalescence and health rehabilitation leave of 05 to 10 days per year.
The convalescence and health rehabilitation leave period includes public holidays, Tet holidays, and weekly rest days. If the convalescence and health rehabilitation leave period starts at the end of the previous year and extends into the beginning of the following year, that period will be counted for the previous year.
- The number of convalescence and health rehabilitation leave days is determined by the employer and the Executive Committee of the grassroots trade union. If the unit does not yet have a grassroots trade union, the decision rests entirely with the employer as follows:
+ A maximum of 10 days for employees whose health has not recovered after a prolonged illness requiring extended treatment;
+ A maximum of 07 days for employees whose health has not recovered after surgery;
+ 05 days for other cases.
- The daily convalescence and health rehabilitation benefit after sickness amounts to 30% of the statutory pay rate.
The current statutory pay rate is VND 1,490,000/month (Decree 38/2019/ND-CP)
Based on the above regulations, the company has decided to grant you 9 days of leave, with the daily convalescence benefit amounting to 30% of the statutory pay rate. Therefore, you will receive VND 4,023,000.
