Child Sick and Hospitalized: How Many Days Off are Parents Entitled To?
According to Clause 1, Article 4 of the Social Insurance Law of 2014, mandatory social insurance includes the following policies:
- Sickness;
- Maternity;
- Occupational accidents and diseases;
- Retirement;
- Death.
Based on Article 27 of the Social Insurance Law of 2014, the period for enjoying policies when a child is sick is regulated as follows:
The period for enjoying policies when a child is sick in a year for each child is calculated based on the number of days for caring for the child, with a maximum of 20 working days if the child is under 03 years old; up to 15 working days if the child is between 03 years old and under 07 years old.
In cases where both parents participate in social insurance, the period for enjoying policies when a child is sick for each father or mother is stipulated in Clause 1 of this Article.
The period of leave to enjoy policies when a child is sick as stipulated in this Article is calculated in working days excluding holidays, Tet, and weekends.
Based on the above regulations, if both you and your spouse participate in mandatory social insurance, you will be entitled to policies when a child is sick. The leave period for each person in the case where the child is under 3 years old is a maximum of 20 days, excluding holidays, Tet, and weekends.
