Can the Life Insurance Contract Be Transferred If the Insurance Company Does Not Agree to the Transfer?
Article 26 of the Insurance Business Law 2000 stipulates the transfer of insurance contracts (in general) as follows:
The policyholder may transfer the insurance contract according to the agreement in the insurance contract.
The transfer of the insurance contract is only effective in cases where the policyholder notifies the insurer in writing about the transfer, and the insurer provides written consent for the transfer, except in cases where the transfer is conducted according to international customs.
...
The condition for transferring the insurance contract is that the policyholder must notify the insurer in writing about the transfer, and the insurer must provide written consent for the transfer.
Therefore, if the insurer does not agree, this transfer does not take effect (is not valid). Hence, in the case of a life insurance contract transfer without the insurer's consent, the transfer cannot be carried out.
Respectfully!
