Can the Husband Take Maternity Leave When His Wife Gives Birth to the Third Child?
Section 2, Article 34 of the 2014 Social Insurance Law stipulates the duration of benefits when a male worker's wife gives birth as follows:
Male employees who are currently paying social insurance when their wife gives birth are entitled to maternity leave as follows:
- 05 working days;
- 07 working days if the wife undergoes surgery or gives birth to a child under 32 weeks of age;
- In the case of twins, 10 working days off; for triplets or more, an additional 03 working days for each child;
- In the case of twins or more and the wife undergoes surgery, 14 working days off are allowed.
The duration of maternity leave stipulated in this section is counted within 30 days from the date the wife gives birth.
The regulation regarding the duration of maternity leave for male employees when their wife gives birth does not depend on whether it is the first or subsequent child.
Thus, a male employee who is currently paying social insurance and whose wife gives birth to their third child is still entitled to maternity leave as specified above.
