Shall the husband receive a lump-sum allowance upon childbirth ưhen his wife gives birth in Vietnam?
Section 2c Official Dispatch 3432/LDTBXH-BHXH in 2016 regarding maternity policies in Vietnam as follows:
Lump-sum allowance upon childbirth in cases where only the father participates in social insurance according to Article 38 of the Law on Social Insurance shall also be applicable to both cases where the mother does not meet the conditions to enjoy maternity policies upon childbirth, but the father meets the conditions specified in Clause 2 Article 9 of Circular 59/2015/TT-BLDTBXH dated December 29, 2015, of the Ministry of Labor, War Invalids, and Social Affairs.
Referring to Clause 2 Article 9 of Circular 59/2015/TT-BLDTBXH, the conditions to enjoy the lump-sum allowance upon childbirth are specifically guided as follows:
- In cases where only the father participates in social insurance, the father must have paid social insurance for at least 06 months within the 12 months before the childbirth;
- For the husband of a woman using a surrogate, he must have paid social insurance for at least 06 months within the 12 months leading up to the receipt of the child.
Thus, if your wife does not meet the conditions to enjoy maternity policies, you—the husband—must have paid social insurance for at least 06 months within the 12 months before the childbirth to receive a lump-sum allowance when your wife gives birth.
