Can people in the same family borrow each other's health insurance to visit a doctor?
According to Article 37 of the Health Insurance Law 2008, the obligations of participants in health insurance are as follows:
Pay health insurance fully and on time.
Use the health insurance card for the right purpose, not lending the health insurance card to others.
Comply with the provisions of Article 28 of this Law when seeking medical examination and treatment.
Abide by the regulations and guidance of the health insurance organization and the medical facility when seeking medical examination and treatment.
Pay medical examination and treatment costs to the medical facility beyond the coverage provided by the health insurance fund.
Based on current regulations, the law does not allow health insurance participants to lend their cards to others. Therefore, people in the same family are not permitted to borrow each other's health insurance cards to visit a doctor.
How much is the fine for lending a health insurance card to others?
According to Article 84 of Decree 117/2020/ND-CP, the administrative penalties for lending a health insurance card to others are as follows:
- Fines for lending a health insurance card to others or using another's health insurance card for medical examination and treatment are prescribed as follows:
a) From VND 1,000,000 to VND 2,000,000 for violations that do not cause damage to the health insurance fund;
b) From VND 3,000,000 to VND 5,000,000 for violations that cause damage to the health insurance fund.
- Measures for remedying consequences:
Require reimbursement of the violated amount to the health insurance fund's revenue account (if any) for the act specified in point b, clause 1 of this Article.
Depending on the level of damage caused to the health insurance fund, different fines will be applied to those who lend health insurance cards to others.
