Pursuant to Article 70 of the Social Insurance Law 2024 on lump-sum social insurance benefits:

Article 70. Lump-sum Social Insurance Benefits

  1. Individuals specified in Clause 1, Article 2 of this Law who have ceased participating in social insurance and submitted a request are entitled to lump-sum social insurance benefits if they meet one of the following conditions:

a) They have reached retirement age but have not contributed to social insurance for 15 years.

In cases where workers do not opt for lump-sum social insurance benefits, they can choose to receive monthly benefits as provided in Article 23 of this Law;

b) They move abroad for permanent residence;

c) They are diagnosed with cancer, paralysis, decompensated cirrhosis, severe tuberculosis, or AIDS;

d) Their working capacity is reduced by 81% or more; they are particularly severely disabled;

dd) They have contributed to social insurance prior to the effective date of this Law, have ceased being obligated to mandatory social insurance for 12 months, are not participating in voluntary social insurance, and have less than 20 years of social insurance contributions;

e) Those specified in points d, đ, and e, Clause 1, Article 2 of this Law, upon demobilization, retirement, or termination of employment, are not subject to mandatory social insurance and do not participate in voluntary social insurance and do not qualify for pensions.

According to the above regulations, individuals whose working capacity is reduced by 81% or more, who have ceased participating in mandatory social insurance, and submitted a request, are entitled to lump-sum social insurance benefits.

What are the 8 rights of individuals entitled to social insurance benefits from July 1, 2025 in Vietnam?

Based on Clause 2, Article 10 of the Social Insurance Law 2024, 8 rights of social insurance beneficiaries from July 1, 2025, are stipulated as follows:

[1] Receive social insurance benefits fully, promptly, conveniently;

[2] Enjoy health insurance in cases where they are receiving pensions; taking sick leave to receive monthly benefits for occupational accidents and diseases; during maternity leave policies from 14 working days or more in a month;

During sick leave policies from 14 working days or more in a month or leave for treatment of diseases listed by the Minister of Health as requiring prolonged treatment; receiving policies stipulated in Article 23 of the Social Insurance Law 2024;

[3] Be reimbursed for medical examination fees in cases not referred by the employer, yet the medical assessment qualifies for social insurance benefits as per the regulations of the Social Insurance Law 2024;

[4] Authorize another person in writing to perform social insurance acts. In cases of authorizing the receipt of pensions, social insurance allowances, and other policies as stipulated by the Social Insurance Law 2024, the authorization document is valid for a maximum of 12 months from the date of authorization.

The authorization document must be authenticated as per the law on authentication;

[5] Individuals aged 80 or older, if desired, may have their pensions, social insurance allowances paid at their residence within the territory of Vietnam by the social insurance agency or service organizations authorized by the social insurance agency;

[6] Be provided with monthly information by the social insurance agency regarding their social insurance benefit status through electronic means; the social insurance agency confirms social insurance benefit information upon request;

[7] File complaints, denunciations, and litigate regarding social insurance in accordance with legal provisions;

[8] Refuse social insurance benefits.

What are policies of mandatory social insurance in Vietnam?

Based on Article 4 of the Social Insurance Law 2024, the types of social insurance benefits include:

Article 4. Types and Social Insurance Benefits

  1. Social retirement allowance includes the following policies:

a) Monthly social retirement allowance;

b) Funeral cost assistance;

c) Health insurance funded by the state budget.

  1. Mandatory social insurance includes the following policies:

a) Sickness;

b) Maternity;

c) Retirement;

d) Survivorship;

dd) Work accident insurance, occupational disease insurance as stipulated by the Labor Safety and Hygiene Law.

Thus, mandatory social insurance includes the following policies: Sickness, maternity, retirement, survivorship, and work accident, occupational disease insurance.

Note: The Social Insurance Law 2024 takes effect from July 1, 2025.
