Can a person who is pregnant authorize another person to submit an unemployment benefit application in Vietnam?
Pursuant to Article 17 of Decree 28/2015/NĐ-CP (amended by Clause 7 Article 1 of Decree 61/2020/NĐ-CP) stipulating the submission of applications for unemployment benefits as follows:
1. Within 03 months from the date of termination of the labor contract or working contract, employees who are unemployed and need to receive unemployment benefits must directly submit 01 application for unemployment benefits in accordance with the provisions of Article 16 of this Decree to the local employment service center where the worker wants to receive unemployment benefits.
2. The employee may authorize another person to submit the application or send the application by post if it falls into one of the following cases:
a) Sickness or maternity with confirmation from a competent medical facility;
b) Having an accident certified by traffic police or a competent medical facility;
c) Fire, flood, earthquake, tsunami, enemy sabotage, epidemic with confirmation from the Chairman of the People's Committee of the commune, ward or town.
The date of submitting the application for unemployment benefits in the above cases is the date the authorized person directly submits the application or the date recorded on the postmark in case of sending by post.
3. The employment service center is responsible for receiving, checking documents, and recording appointments to return results according to the form prescribed by the Minister of Labor, War Invalids and Social Affairs and give the ballot directly to the applicant or send it by mail for those who submit the application by post; In case the dossier does not comply with the provisions of Article 16 of this Decree, it shall be returned to the submitter and clearly state the reason.
4. Within 15 working days from the date of submitting the application for unemployment benefits, if the employee does not need to receive unemployment benefits, the employee must directly or authorize another person to submit a request not to receive unemployment benefits to the employment service center where the employee has submitted a request for unemployment benefits.
According to the regulations above, a pregnant woman who has a confirmation from a competent medical facility can authorize another person to submit an application for unemployment benefits on her behalf.
If you are pregnant, you can authorize your husband to submit an application for unemployment benefits on your behalf with the confirmation of the hospital where you are staying for monitoring and examination.

According to Article 50 of the Law on Employment in 2013, the level, duration, and timing of unemployment benefits are as follows:
1. The monthly unemployment allowance level equals 60% of the average monthly wage of 6 consecutive months before the worker becomes unemployed on which unemployment insurance premiums are based, but must not exceed 5 times the basic wage level, for workers receiving wages under the State-prescribed regime, or must not exceed 5 times the region-based minimum wage level under the Labor Code, for workers who pay unemployment insurance premiums under the wage regime decided by employers at the time of termination of the labor contract or working contract.
2. The duration of unemployment allowance receipt is based on the number of months of payment of unemployment insurance premiums. This duration is 3 months if the period of payment of unemployment insurance premiums is between full 12 months and full 36 months, which is added with 1 month for each additional period of payment of full 12 months, but must not exceed 12 months.
3. The time for unemployment allowance receipt is counted from the 16 th day after the date of submission of a complete dossier for receipt of unemployment allowance as specified in Clause 1, Article 46 of this Law.
According to the regulations above, a person who has participated in unemployment insurance for 24 months will be eligible for 3 months of unemployment benefits.
