After paying unemployment insurance for how many months, will I receive vocational training support in Vietnam?

Article 55 of the Employment Law 2013 stipulates conditions for vocational training support as follows:

The workers defined in Clause 1, Article 43 of this Law who currently pay unemployment insurance premiums are entitled to vocational training support when fully meeting the following conditions:

1. The conditions specified in Clauses 1, 3 and 4, Article 49 of this Law;

2. Having paid unemployment insurance premiums for at least full 9 months within 24 months before terminating labor contracts or working contracts under law.

Thus, according to the above regulations in Vietnam, if you have paid unemployment insurance for 9 months or more in the 24 months before you terminate your employment contract, you will receive vocational training support.

Where to submit an application for vocational training support in Vietnam?

In Article 11 of Circular 28/2015/TT-BLDTBXH, any employee wishing to take vocational course shall directly apply for vocational training support prescribed in Clause 2 Article 25 of Decree No. 28/2015/ND-CP shall be guided as follows:

1. The employee receiving unemployment benefit shall apply for vocational training support at the employment service center where the unemployment benefit is provided.

Example 16: Ms. Mai Thi K is receiving unemployment benefit in Hai Duong province. During the payout period, she wishes to take vocational courses. Accordingly, she must send an application for vocational training support to the employment service center of Hai Duong province for consideration. The Director of Service of Labor, War Invalids and Social Affairs of Hai Duong province shall consider deciding the vocational training support for her.

2. If an employee who has a payment period of at least 9 months but does not receive any unemployment benefit wishes to take a vocational course, she/he shall send an application for vocational training support together with a claim for unemployment benefit at the employment service center where the employee wishes to take the vocational course.

Example 17: Mr. Nguyen Van M works in Binh Duong province and has a payment period of consecutive 11 months. After terminating the labor contract, if he wishes to take vocational course in Ho Chi Minh City, he shall send an application for vocational training support together with a claim for unemployment benefit to the employment service center of Ho Chi Minh City.

According to this Article, you can submit an application for vocational training support at employment service center where you are receiving unemployment benefits in Vietnam.

What documents are included in the application for vocational training support in Vietnam? 

In Article 24 of Decree 28/2015/ND-CP amended by Clause 12, Article 1 of Decree 61/2020/ND-CP, regulations on application for support for vocational education are as follows:

1. Application for vocational education support for the employee who are awaiting the results of processing of application for unemployment benefit, or are receiving unemployment benefit but wishing to take vocational training course in the locality where they are expecting such processing results or are receiving unemployment benefit is a request for support for vocational training and education made using Form No. 03 enclosed herewith.

2. Application for vocational education support for the employee who are receiving unemployment benefit but wishing to take vocational training course in the locality other than the place where they are enjoying unemployment benefit, shall include the request form for support for vocational training and education made according to clause 1 of this Article and the decision on entitlement to unemployment benefit. The decision on entitlement to unemployment benefit to be submitted is the primary copy or the certified true copy or the duplicated copy enclosed with the primary copy for verification purpose.

3. An application for vocational training and education support for the employee who does not fall into the cases prescribed in clause 1 and clause 2 of this Article shall include:

a) Application form for unemployment benefit;

b) Application form for support for vocational education and training under the provisions of clause 1 of this Article;

c) The primary copy or the certified true copy or the copy annexed to the primary copy for verification purpose of one of the documents prescribed in clause 2 of Article 16 in the Decree No. 28/2015/ND-CP, which is amended and supplemented in Clause 6 of Article 1 in this Decree;

d) Social insurance book.

If the employee has submitted an application for unemployment benefit but does not meet the eligibility conditions, the application for vocational training support shall play its role as the request for vocational training support as prescribed in clause 1 of this Article and the Notice of the employee's failure to meet the conditions for unemployment benefit issued by the employment service center.

Thus, application for vocational training support in Vietnam will include the documents as prescribed above.
