Disciplinary actions for upper secondary school students who fail to comply with school rules in Vietnam

Based on Article 38 of the lower secondary school, upper secondary school and multi-level school charter, issued together with Circular 32/2020/TT-BGDDT, the provisions on rewards and disciplinary actions for upper secondary school students are as follows:

Rewards and Disciplinary Actions

  1. Students who achieve academic and behavioral accomplishments are rewarded by teachers, the school, and education management levels in the following forms:

a) Commendation in class or in front of the entire school.

b) Awarding student titles according to regulations.

c) Issuing certificates, commendation letters, and awards if students achieve outstanding or significant improvement in certain areas of study, competitions, or as authorized by the Ministry of Education and Training.

d) Other forms of rewards.

  1. Students who violate shortcomings during the course of study and training are educated or disciplined in the following forms:

a) Reminder, support, and direct assistance to help students overcome their shortcomings.

b) Reprimand, informing parents to collaborate in helping students overcome their shortcomings.

c) Temporary suspension from school with a specific duration and application of other educational measures as prescribed by the Ministry of Education and Training.

Therefore, upper secondary school students who fail to comply with school rules can be disciplined in one of the following forms: reminder, reprimand, or temporary suspension from school.

a) The Student Disciplinary Council is established to review or clear disciplinary actions against students for each specific case. The Disciplinary Council is established and chaired by the principal. Members of the council include: vice-principal, secretary of the Ho Chi Minh Communist Youth Union (if available), head of the Ho Chi Minh Young Pioneer Organization (if available), homeroom teacher of the class with the violating student, several teachers with educational experience, and the head of the parent representative board of the school.

b) The Staff Disciplinary Council is established to review and recommend disciplinary actions against staff members, teachers, and employees for each specific case. The establishment, composition, and operation of the staff disciplinary council are governed by legal regulations.

  1. Advisory Council

Advisory councils are established by the principal as needed for specific tasks. The duties, composition, and operating time of advisory councils are stipulated by the principal.

Therefore, according to the regulations, the student disciplinary council is established to review or clear disciplinary actions against students for each specific case.

Thus, upper secondary school students who fail to comply with school rules are subject to review by the student disciplinary council.
