Forms of disciplinary action and principles of application
1. Forms of disciplinary action
a) Students violating the internal rules of the reformatory school shall, depending on the nature and severity of the violation, be disciplined by one of the forms specified in Clause 2, Article 23 of Decree No. 140/2021/ND-CP;
b) Inmates violating the internal rules of the compulsory education facility shall, depending on the nature and severity of the violation, be disciplined by one of the forms specified in Clause 2, Article 38 of Decree No. 140/2021/ND-CP.

- Students and inmates who violate the internal rules must be promptly and strictly disciplined according to the law. Each violation shall be dealt with one disciplinary measure. In the event of multiple students or inmates violating the rules in one incident, each individual involved will be disciplined. If an individual has multiple violations in one incident, one overall disciplinary measure is applied; different violations are not separated and disciplined by different measures.
- When disciplining students or inmates, considerations should include the nature, level, consequences, motives, purposes, reasons, degree of repentance, willingness to correct violations, and efforts to remedy the consequences to determine an appropriate disciplinary measure.

- Students who commit one of the violations specified in Article 1 of the internal rules of the reformatory school shall be reviewed and disciplined by reprimand.
Inmates who commit one of the violations specified in Article 1 of the internal rules of the compulsory education facility shall be reviewed and disciplined by reprimand.
- Consider disciplining by warning for students or inmates in the following cases:
+ Students or inmates who have been disciplined by reprimand but continue to commit one of the violations specified in Article 1 of the internal rules of the reformatory school or compulsory education facility;
+ Students commit one of the violations specified in Clauses 1, 2, 4, 5, 6, 7, 8, 9, 11, 12, 14, 15, 16, 17, and 18 of Article 2 of the internal rules of the reformatory school; inmates commit one of the violations specified in Clauses 1, 2, 4, 5, 6, 7, 8, 9, 12, 13, 15, 16, 17, 18, and 19 of Article 2 of the internal rules of the compulsory education facility.
- Consider disciplining by education in a separate room for students, and isolation in a disciplinary cell for inmates in the following cases:
+ Students who have been disciplined by warning but continue to commit one of the violations specified in Article 1 and Clauses 1, 2, 4, 5, 6, 7, 8, 9, 11, 12, 14, 15, 16, 17, and 18 of Article 2 of the internal rules of the reformatory school; inmates who have been disciplined by warning but continue to commit one of the violations specified in Article 1 and Clauses 1, 2, 4, 5, 6, 7, 8, 9, 12, 13, 15, 16, 17, 18, and 19 of Article 2 of the internal rules of the compulsory education facility;
+ Students commit one of the violations specified in Clauses 3, 10, and 13 of Article 2 of the internal rules of the reformatory school; inmates commit one of the violations specified in Clauses 3, 10, 11, and 14 of Article 2 of the internal rules of the compulsory education facility.
- Inmates who have been disciplined by isolation in a disciplinary cell and continue to violate the internal rules of the compulsory education facility shall be considered for discipline by restricting the number of visits from relatives, phone communication, and the number and amount of received gifts.
