According to point b, clause 2, Article 2 of Joint Circular 01/2006/TTLT-BGDDT-BNV-BTC, the eligibility for job-based preferential allowances in Vietnam is stated as follows:

The entities specified in clause 1 of this section shall not be eligible for the preferential allowance in the following periods:

- The period of working, studying abroad receiving 40% of the salary according to the provisions in clause 4, Article 8 of Decree No. 204/2004/ND-CP;

- The period of work and study within the country without continuous teaching for over 3 months;

- The period of personal leave without pay for more than 01 month;

- The period of sick leave, maternity leave exceeding the duration as per current social insurance regulations;

- The period of suspension from teaching.

Thus, teachers who are seconded to the Division of Education and Training without directly teaching and assume management, administrative affairs, or other specialized tasks for over 3 continuous months are not eligible for the job-based preferential allowance.

However, if during the secondment period, teachers still perform direct teaching tasks at educational institutions, they may still be eligible for the job-based preferential allowance according to the regulations.

Previously, Article 1 of Decision 42/2011/QD-TTg stipulated retention policies for preferential allowances as follows:

Retaining preferential allowance policies for teachers teaching in public preschools and general education institutions who have been seconded or transferred (hereinafter collectively referred to as transfers) from September 1, 2010, to May 31, 2015, to work in the Divisions of Education and Training; Departments of Education and Training without holding leading positions and not receiving leader allowances, to support teachers in overcoming difficulties in the early stage of implementing the transfer decision.

However, Decision 42/2011/QD-TTg has been abolished by clause 53, Article 1 of Decision 01/2020/QD-TTg and no new regulation on this matter is currently in effect.

What are the job-based preferential allowance levels for preschool teachers in Vietnam?

Under Article 2 of Decision 244/2005/QD-TTg, the allowance levels and calculation method are specified as follows:

Allowance levels and calculation method

1. The preferential allowance levels for teachers are defined as follows:

a) A 25% allowance level is applicable for teachers directly teaching in universities, colleges, training institutes of Ministries, Ministry-equivalents, agencies under the Government of Vietnam, Communist Party organizations, political-social organizations at the Central level, and political schools of provinces and cities directly under the Central Government (excluding teachers teaching in pedagogical schools, pedagogical faculties and teachers of Marxism-Leninism Science, Ho Chi Minh Thought);

b) A 30% allowance level is applicable for teachers directly teaching in lower secondary schools, upper secondary schools, centers for general technical education and vocational orientation, continuous education centers, vocational centers in plains, cities, towns; technical lower secondary schools, vocational schools; political training centers of districts, districts, towns, cities directly under provinces;

c) A 35% allowance level is applicable for teachers directly teaching in preschools, primary schools in plains, cities, towns; lower secondary schools, upper secondary schools, centers for general technical education and vocational orientation, continuous education centers, vocational training centers in mountainous, island, remote, and isolated areas;

d) A 40% allowance level is applicable for teachers directly teaching in pedagogical schools, pedagogical faculties (university, college, secondary), educational management training schools and teachers teaching political entitiess in vocational schools, vocational schools;

đ) A 45% allowance level is applicable for teachers directly teaching entitiess of Marxism-Leninism, Ho Chi Minh Thought in universities and colleges;

e) A 50% allowance level is applicable for teachers directly teaching in preschools, primary schools in mountainous, island, remote, and isolated areas.

2. The preferential allowance levels specified in clause 1 of this Article are calculated on the current salary according to step and grade including leader allowances and extra-seniority allowances (if any).

Therefore, the preferential allowance levels for preschool teachers are as follows:

- A 35% allowance level is applicable for teachers directly teaching in preschools in plains, cities, and towns.

- A 50% allowance level is applicable for teachers directly teaching in preschools in mountainous, island, remote, and isolated areas.

What is the formula for calculating the job-based preferential allowance for preschool teachers in Vietnam?

Under Section 3 of Joint Circular 01/2006/TTLT-BGD&DT-BNV-BTC, the allowance levels and calculation method are specified as follows:

Preferential allowance = statutory minimum wage x [current salary coefficient according to step and grade + leader allowance coefficient (if any) + % (converted to coefficient) of extra-seniority allowance (if any)] x % preferential allowance level.

Thus, the formula for calculating the job-based preferential allowance for preschool teachers in Vietnam is as follows:

Preferential allowance = statutory minimum wage x [current salary coefficient according to step and grade + leader allowance coefficient (if any) + % (converted to coefficient) of extra-seniority allowance (if any)] x % preferential allowance level.
