Vietnam: Newly issuing new document forms used in the organization and operation of social funds and charitable funds

Recently, the Ministry of Home Affairs of Vietnam issued Circular No. 04/2020/TT-BNV on elaborating to Decree No. 93/2019/ND-CP dated November 25, 2019 of Vietnam’s Government on organization and operation of social funds and charitable funds.

Circular No. 04/2020/TT-BNV of the Ministry of Home Affairs of Vietnam issues and guides document forms for organization and operation of social funds and charitable funds, including:

- List of document forms applied to funds and relevant individuals, organizations, including 18 forms (Annex I);

- List of document forms applied to regulatory agencies, including 17 forms (Annex II).

Note: Display format and technique of documents shall conform to Decree No. 30/2020/ND-CP dated March 5, 2020 of Vietnam’s Government on records management.

Moreover, Circular No. 04/2020/TT-BNV also guides the dossiers for notification of formation of juridical persons affiliated to social funds and charitable funds, which include:

- Decision on formation of juridical persons (original copies) and copy of License for operation;

- Copies of following documents: regulations on organization and operation of juridical persons; decisions on assigning heads of juridical persons.

More details can be found in Circular No. 04/2020/TT-BNV of the Ministry of Home Affairs of Vietnam, which takes effect from December 01, 2020 and replaces Circular No. 02/2013/TT-BNV.
