Update on procedures for notification of importing cultural products not for commercial purposes in Vietnam

Article 9 of Decree 32/2012/ND-CP is amended on the procedures for notification of importation of cultural products not for commercial purposes as follows:

(1) Individuals or organizations with imported cultural products under the cases specified in Article 8 of Decree 32/2012/ND-CP shall submit one set of notification dossiers for the importation of cultural products not for commercial purposes through one of the following methods: directly, via postal service, electronically, or through the National Single Window Portal to the competent state authority for receipt.

(2) The notification dossier for the importation of cultural products includes:

- Notification of importation of cultural products according to Appendix III attached to Decree 32/2012/ND-CP;

- One photograph of the front, center of the cultural product; for sculptures, supplement with one photograph of each side: left, right, and back of the artwork, with captions, with a minimum photo size of 13 x 18 cm, printed on paper or recorded on a mobile storage device (in the case of direct submission or postal submission) or digital format photo (in the case of electronic submission, submission via the National Single Window Portal). A notarized translation detailing the content for recordings, videotapes using foreign languages;

- Copy of the bill of lading or notice of receipt (if any).

(3) The competent state authority specified in Article 8 of Decree 32, upon receipt of the notification, is responsible for inspecting the content of the cultural product as stipulated in Clause 1, Article 6 of Decree 32 and immediately issuing a Receipt of Notification of Importation of Cultural Products to the applicant according to Appendix IV attached to Decree 32.

(4) In cases where prohibited exports, imports of cultural products are detected as stipulated in Clause 1, Article 6 of Decree 32, within 2 working days from the date of receiving a duly completed dossier, the competent state authority specified in Article 8 of Decree 32 shall send a Notification to Halt the Importation of Cultural Products to the Customs authority, individuals, and organizations according to Appendix V attached to Decree 32.
