Regarding this issue, LawNet would like to answer as follows:

1. Eligibility for physical hardship, hazard and danger allowance paid to teachers performing practical teaching duties in Vietnam

According to Article 10 of Decree 113/2015/ND-CP, eligibility for allowance physical hardship, hazard and danger allowance paid to teachers performing practical teaching duties in Vietnam is as follows

- Teachers must perform practical or integrative teaching duties (hereinafter referred to as practical teachers) in practice classrooms or facilities of public vocational education institutions or enterprises, manufacturing, trading and service business establishments associated with academic disciplines which involve one of physical hardship, hazard or danger as follows:

+ Direct contact with poisonous substances, gases or dusts; practical teaching work performed in the work environment that may easily inflict infection and infectious diseases in accordance with regulations;

+ Practical teaching work performed in the high-pressure or low-oxygen, very hot or cold work environment which exceeds the required standard;

+ Practical teaching work performed for academic disciplines that emit loud noise or at places that create constant high-frequency vibration exceeding rigorous standards of occupational safety and hygiene;

+ Practical teaching work performed in the work environment which produces radioactivity, radiation or electromagnetic field exceeding the required standard.

- The list of academic disciplines which have arduous, hazardous and dangerous attributes shall be issued by the Ministry of Labor, War Invalids and Social Affairs.

2. Levels of physical hardship, hazard and danger allowance paid to teachers performing practical teaching duties in Vietnam

Pursuant to Article 11 of Decree 113/2015/ND-CP, the physical hardship, hazard and danger allowance shall be calculated based on the base salary, which is categorized into the following level:

- The level of 0.1 applicable to teachers teaching academic disciplines which involve one of physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.2 applicable to teachers teaching academic disciplines which involve two physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.3 applicable to teachers teaching academic disciplines which involve three physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.4 applicable to teachers teaching academic disciplines which involve four physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

3. Calculation and entitlement of physical hardship, hazard and danger allowance paid to teachers performing practical teaching duties in Vietnam

According to Article 6 of Circular 22/2017/TT-BLDTBXH, the calculation and enjoyment of physical hardship, hazard and danger allowance paid to teacherswho teach the practice and integration of physical hardship, hazard and danger disciplines and occupations are specified in Article 12 of Decree 113/2015/ND-CP as follows:

- Pursuant to Article 10 and Article 11 of Decree 113/2015/ND-CP, the head of the vocational education institution shall be responsible for determining the allowance levels for teachers who teach practice and integrate physical hardship, hazard and danger disciplines and professions accordingly.

- How to calculate monthly physical hardship, hazard and danger allowances

Physical hardship, hazard and danger allowance + (Hard, toxic, and dangerous allowance x base salary) / (Normal teaching hours of teachers in a year / 12 months) x Number of hours of practical training, industry integration, and physical hardship, hazard and danger occupations in a month.

Example 11: Teacher F is a teacher who teaches practical welding at the practice workshop of an intermediate school (directly exposed to toxic gases); the level of allowance for physical hardship, hazard and danger work is 0.1; the base salary is 1,300,000 VND; the norm of teachers' teaching hours in a year is 480 hours; the actual practice hours per month are 30 hours. The physical hardship, hazard and danger allowance that teacher F is entitled to every month is calculated as follows:

Physical hardship, hazard and danger allowance + (0.1 x 1,300,000 VND)/(480 hours/12 months) x 30 hours + 97,500 VND.

 

Example 12: Teacher G is a teacher who teaches practical welding in ship tunnels, barge tunnels (direct contact with toxic gases and an oxygen-deficient environment); the level of allowance for physical hardship, hazard and danger work shall be 0.2; the base salary is 1,300,000 VND; the norm of teachers' teaching hours in a year is 480 hours; the actual practice hours per month is 30 hours. The physical hardship, hazard and danger allowance that teacher G is entitled to every month is calculated as follows:

Physical hardship, hazard and danger allowance + (0.2 x 1,300,000 VND)/ (480 hours/12 months) x 30 hours + 195,000 VND.
