The Minister of Natural Resources and Environment of Vietnam has just issued Circular 10/2024/TT-BTNMT, which stipulates the regulations on code of certificate of land use rights and ownership of property affixed to the land in Vietnam.

On July 31, 2024, the Minister of Natural Resources and Environment issued Circular 10/2024/TT-BTNMT prescribing cadastral records, certificates of land use rights and ownership of property affixed to the land, which takes effect in Vietnam from August 1, 2024.

According to Article 15 of Circular 10/2024/TT-BTNMT on the code of certificate of land use rights and ownership of property affixed to the land in Vietnam:

- The code of certificate of land use rights and ownership of property affixed to the land (hereinafter referred to as the Certificate Code) is unique nationwide, automatically issued by the software of the land information system when the National Land Information System is officially put into operation and exploitation.

- The Certificate Code is displayed at the top right corner immediately below the QR code on page 1 of the Certificate of Land Use Rights, Property Ownership Associated with Land, consisting of a set of 12 (twelve) alphanumeric characters as prescribed in clauses 3, 4, and 5 of Article 15 of Circular 10/2024/TT-BTNMT.

- The first two (02) characters of the Certificate Code indicate the authority issuing the Certificate of Land Use Rights, Property Ownership Associated with Land. Specifically:

- In case the provincial People's Committee or provincial land management authority is authorized to issue the Certificate of Land Use Rights, Property Ownership Associated with Land for the first time, it is represented as: "T1";

- In case the Land Registration Office issues the Certificate of Land Use Rights, Property Ownership Associated with Land to organizations or foreign individuals when performing land or property registration procedures, it is represented as: "T2";

- In case the Land Registration Office issues the Certificate of Land Use Rights, Property Ownership Associated with Land to individuals, overseas Vietnamese, or communities during land or property registration procedures, it is represented as: "T3";

- In case the district People's Committee issues the Certificate of Land Use Rights, Property Ownership Associated with Land for the first time, it is represented as: "H1";

- In case the Branch Land Registration Office issues the Certificate of Land Use Rights, Property Ownership Associated with Land to individuals, overseas Vietnamese, or communities during land or property registration procedures, it is represented as: "H2".

- The next two (02) characters of the Certificate Code indicate the administrative unit code of the province of the authority issuing the Certificate of Land Use Rights, Property Ownership Associated with Land, structured according to the administrative unit codes table by the Government of Vietnam.

- The next eight (08) characters of the Certificate Code indicate the sequential number of the Certificate Code within the province or centrally-run city, issued automatically by the software of the National Land Information System, starting from 00000001.

Example: assigning the Certificate Code for the Certificate of Land Use Rights, Property Ownership Associated with Land issued for the first time by the Hanoi City People's Committee:

T 1 01 00000001

- The agency advising and assisting the Minister of Natural Resources and Environment in state management of cadastral dossier establishment, modification, land registration, and Certificate issuance performs centralized management of the Certificate Code nationwide.

Regulations on the QR Code of the Certificate in Vietnam

Specifically, Article 14 of Circular 10/2024/TT-BTNMT stipulates the QR code of the Certificate as follows:

- The QR code printed on the Certificate is used to store and display detailed information of the Certificate and information for managing the QR code.

- The feedback information from the QR code has the same value as the information on the Certificate, consistent with the information in the land database or recorded in the cadastral dossier for areas without a land database.

- The application of the QR code on the Certificate must meet the technical requirements for the QR code under the Vietnam standard TCVN 7322:2009 (ISO/IEC 18004:2006).

- The QR code of the Certificate must be created and printed on the same software application managing the local land database and integrated into the national land database.

- The size of the QR code printed on the Certificate is 2.0 cm x 2.0 cm. The QR code is displayed at the top right corner of page 1 of the Certificate of Land Use Rights, Property Ownership Associated with Land for the first issuance; in case of subsequent information changes after Certificate issuance, the QR code is displayed in the right-hand column of the "Change content and legal basis" section at item 6, page 2 of the Certificate.

More details can be found in Circular 10/2024/TT-BTNMT, which comes into force in Vietnam from August 1, 2024.
