The Minister of Natural Resources and Environment of Vietnam has just issued Circular 10/2024/TT-BTNMT, which stipulates the provisions on contents of cadastral records starting August 1, 2024

On July 31, 2024, the Minister of Natural Resources and Environment of Vietnam issued Circular 10/2024/TT-BTNMT concerning the cadastral record, Land Use Rights Certificate, and and ownership of property affixed to the land. It takes effect in Vietnam from August 1, 2024.

Provisions on contents of cadastral records in Vietnam starting August 1, 2024

According to Article 6 of Circular 10/2024/TT-BTNMT, the content of the cadastral record is prescribed as follows:

- Information regarding parcels, linear geographical objects, including:

+ Number code;

+ Address;

+ Boundary;

+ Area;

+ Land type;

+ Land use form;

+ Land use term;

+ Land use origin;

+ Information on financial obligations;

+ Information on land use rights restrictions and rights to adjacent parcels (if any);

+ Information on measurement documents.

- Information on properties attached to the land, including: property name, property characteristics, ownership form, ownership term, property address, and property rights restrictions.

- Information on land users, property owners attached to the land, and persons assigned to manage the land.

- Information on the status of land use rights, ownership rights of properties attached to the land, and rights assigned to manage the land.

- Information on land and property attached to land changes.

- Presentation of information within components of the cadastral record as follows:

+ Information prescribed at points a, d, and dd, clause 1, Article 6 of Circular 10/2024/TT-BTNMT is reflected in the cadastral map, land parcel registry, and cadastral book;

+ Information prescribed at point c, clause 1, Article 6 of Circular 10/2024/TT-BTNMT is reflected in the cadastral map;

+ Information prescribed at points b, e, g, h, i, k, and l, clause 1, clause 2, clause 4, clause 5, Article 6 of Circular 10/2024/TT-BTNMT is reflected in the cadastral book;

+ Information prescribed at clause 3, Article 6 of Circular 10/2024/TT-BTNMT is reflected in the land parcel registry and cadastral book;

+ Information prescribed in Article 6 of Circular 10/2024/TT-BTNMT is specified at Articles 8, 9, 10, 11, 12, and 13 of Circular 10/2024/TT-BTNMT.

Provisions on information in the cadastral records in Vietnam

- The information in the cadastral record must ensure consistency among the components of the cadastral record, except in cases specified in clauses 2, 3, and 4, Article 7 of Circular 10/2024/TT-BTNMT.

- In case of inconsistent information among cadastral record documents, cross-check and verify the documents in the cadastral record and the registration and issuance procedure records to determine the information as the basis for consistent cadastral record correction.

- In case of creating a new cadastral map to replace the documents and data used to carry out previous registration and certificate issuance procedures, if the Certificate has been reissued according to the new cadastral map, determine the information according to the reissued Certificate results.

- In case of creating a new cadastral map to replace the documents and data used to carry out previous registration and certificate issuance procedures but not yet reissued the Certificate according to the new cadastral map, determine the information as follows:

+ Information on land users, property owners attached to the land, information on land use rights, property ownership rights attached to the land are determined according to the issued Certificate; if the issued Certificate does not fully reflect the information, determine the information according to the cadastral book and the registration and certificate issuance procedure records;

+ Information on boundary lines (shape, dimensions of sides, and coordinates of parcel vertices), parcel area is determined according to the new cadastral map; if the actual boundary line of the parcel on the new cadastral map has changed compared to the boundary reflected in the issued Certificate, the information on the boundary line and land use area is determined according to the issued Certificate.
