Cases considered severe traffic accidents under new regulations in Vietnam 

Under Clause 1, Article 5 of Circular 26/2024/TT-BCA, the classification of traffic accidents in Vietnam is defined as follows:

According to the level of human and property damage, traffic accidents are classified into especially serious traffic accidents, very serious traffic accidents, serious traffic accidents, less serious traffic accidents, and traffic collisions.

- Especially serious traffic accidents include one of the following cases:

+ Causing the death of 03 or more people;

+ Causing injury or harm to the health of 03 or more people with a total bodily injury rate of these people being 201% or more;

+ Causing property damage of VND 1,500,000,000 or more.

Cases considered less serious traffic accidents in Vietnam

Also under Clause 4, Article 5 of Circular 26/2024/TT-BCA:

Less serious traffic accidents include one of the following cases:

- Causing injury or harm to the health of one person with an injury rate of 11% to under 61%;

- Causing injury or harm to the health of 02 or more people with a total injury rate of these people from 11% to under 61%;

- Causing property damage from VND 10,000,000 to under VND 100,000,000.

Group of statistical indicators regarding information about operators, pedestrians, and victims in building the traffic accident database in Vietnam

- Information about road vehicle operators:

+ Full name, date of birth, personal identification number or passport or other valid international travel documents (for foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, phone number (if any);

+ operator's license, road traffic law knowledge certificate, or certificate for operating specialized motorcycles (number, class, expiry date, year of issue); place of training; place of examination; place of issue;

+ At the time of the traffic accident, whether the operator had alcohol, drugs, or other substances prohibited by law in their blood or breath; whether they were wearing a seatbelt (for cars); wearing a helmet (for motorcycles, motorbikes, bicycles); using a handheld phone (or other electronic devices); or other distraction cases; whether they caused the accident;

+ After the traffic accident, whether the operator stayed at the scene, left the scene, or fled from the scene.

- Information about pedestrians:

+ Full name, date of birth, personal identification number or passport or other valid international travel documents (for foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, phone number (if any);

+ Walking across the road at a designated crosswalk or not, walking on the sidewalk, walking in restricted areas for pedestrians, walking in areas for vehicles, using alcohol, drugs, or other substances prohibited by law, using a handheld phone (or other electronic devices); or other distraction cases.

- Information about the victims includes:

+ Full name, date of birth, personal identification number or passport or other valid international travel documents (for foreigners), place of residence, gender (male, female), nationality, ethnicity, occupation, phone number (if any);

+ Whether the victim was a vehicle operator; a passenger, service staff, pedestrian, or another related person who died or was injured (percentage of bodily injury) in the traffic accident.
