Abandoned Children are Given Priority in Choosing a Living Family

Recently, the Government of Vietnam announced a Draft Decree amending and supplementing certain provisions on adoption issues of Decree 19/2011/ND-CP guiding the Law on Adoption.

According to the regulations in the Draft, the State enhances the search for families to adopt abandoned children by encouraging individuals and organizations to adopt.

In this Draft, the State prioritizes the option for children to find alternative families when they have the need and do not wish to live with their current individual or family by:

- Seeking alternative families for children according to regulations; or- Placing them in nurturing institutions and then seeking alternative families for the children.

Additionally, in the procedures for international adoption, a new condition has been added that if the abandoned child’s biological parents have been identified, the Department of Justice must obtain the opinion of the biological parents before completing the international adoption confirmation procedures.
