Guidance on Procedures for Title Transfer of "Non-Principal Owner Vehicles"

From 2020, individuals driving unauthorized vehicles will be subject to administrative penalties according to the provisions of Decree 100/2019/ND-CP. To avoid penalties in this situation, individuals need to complete the title transfer procedures for "unauthorized vehicles".

To be specific, pursuant to Clause 2, Article 10 of Circular 58/2020/TT-BCA, the procedures for title transfer for a “non-registered vehicle” are as follows:

Firstly, organizations and individuals selling, transferring, gifting, allocating, or inheriting a vehicle must declare and submit the vehicle registration certificate and license plate, specifically:

- Transferring title to an organization or individual in a different province or central city: The vehicle owner directly or authorizes an individual or service organization to submit the vehicle registration certificate and license plate to the vehicle registration authority;- Transferring title to an organization or individual within the same province or central city: The vehicle owner directly or authorizes an individual or service organization to submit the vehicle registration certificate to the vehicle registration authority (in case the organization or individual buying, being transferred, gifting, allocated, or inheriting immediately completes the title transfer procedures, there is no need to complete the procedure for revoking the vehicle registration certificate).

Secondly, officers responsible for vehicle registration will revoke the vehicle registration certificate and license plate on the vehicle registration system, issue a certificate of registration revocation, and provide a temporary license plate.

Thirdly, the organization or individual buying, being transferred, gifting, allocated, or inheriting the vehicle must contact the vehicle registration authority at their residence to submit the following documents:

1. Vehicle registration declaration form.

2. Documents transferring vehicle ownership, including one of the following:

- Invoice, financial documents (receipt, payment slip), or purchase, gift documents (decision, contract, inheritance document) according to legal regulations;- Sale, gift document from an individual with notarization or authentication or verification from the employer for the armed forces and foreigners working in diplomatic missions, consular offices, or international organizations where the vehicle is registered to the employer's address;- For decommissioned police vehicles: Decision on vehicle decommissioning from the authorized level and an invoice for selling public assets or an invoice for selling state assets;- For decommissioned military vehicles: Vehicle registration certificate, verification letter confirming the vehicle has been removed from military equipment by the Department of Vehicles and Machinery, Ministry of National Defense, and an invoice for selling public assets or an invoice for selling state assets.

3. Vehicle registration fee documents:

- Receipt or Payment receipt to the state treasury or payment authorization through the bank to pay the registration fee, or other documents for paying the registration fee according to legal regulations, or data information sheet for paying the registration fee printed from the vehicle registration management system (fully indicating brand, model, vehicle type, engine number, chassis number of the vehicle). If multiple vehicles share one registration fee document, each vehicle must have a certified copy according to regulations or confirmation from the issuing authority;- Vehicle exempt from registration fee: Registration fee declaration with confirmation from the tax authority.

4. Certificate of registration revocation, license plate (not applicable in cases of immediate title transfer within the same province after completing the vehicle ownership transfer procedure).

At the same time, present the vehicle owner's documents (national ID, citizen ID, household registration book, etc.) to complete the title transfer registration procedures.

Fourthly, the vehicle owner receives a scheduled appointment slip for selecting the license plate number in the vehicle registration system; receives an appointment slip for the vehicle registration certificate, pays the registration fee, and receives the license plate.

Finally, officers responsible for vehicle registration complete the file and issue the vehicle's official registration certificate.

It can be seen that the law has specifically stipulated the procedures for title transfer in the case of “non-registered vehicle.” Therefore, the public should take note of these procedures to participate in traffic in accordance with the law.
