Vietnam’s new regulation on Draft report on maritime accident investigation

The Ministry of Transport of Vietnam issued Circular No. 39/2017/TT-BGTVT on amendments to some articles of Circular No. 34/2015/TT-BGTVT on regulations on maritime accident reporting and investigation.

According to Circular No. 39/2017/TT-BGTVT of the Ministry of Transport of Vietnam, making and managing Draft report on maritime accident investigation are prescribed as follows:

- After making a draft report on maritime accident investigation, the investigation team shall send a copy of the draft report to the ship owner, ship operator, Vietnam Inland Waterway Administration and Vietnam Maritime Administration for comments. After receiving the draft report, Vietnam Maritime Administration Vietnam Maritime shall send a copy of the draft report to the maritime authority of the country whose flag is raised by the ship for comments.

- The maritime authority of the country whose flag is raised by the ship, ship owner, and relevant ship operator must not publish or grant access to the draft report or any part thereof without the consent of the investigation team, Director of the port authority or Vietnam Maritime Administration.

- Within 30 days from the day on which the draft report is sent, the maritime authority of the country whose flag is raised by the ship, ship owner, relevant ship operator shall send comments about the draft reports.
