This procedure is specifically regulated in Circular 01/2019/TT-BLDTBXH issued by the Ministry of Labor, Invalids and Social Affairs on January 2, 2019.
Circular 01 stipulates the procedures and sequences for re-issuance, renewal, and revocation of the Disability Certificate as follows:
- In case there is a need to renew or re-issue the Disability Certificate, the disabled person or their legal representative shall submit an application to the People's Committee at the commune level where the disabled person resides.
- The commune-level People's Committee shall re-issue the Disability Certificate and simultaneously revoke the old Disability Certificate.
- Within 5 working days, the Chairman of the commune-level People's Committee shall, based on the retained records, decide to re-issue or renew the Disability Certificate.
- In the following cases:
- Change in the type of disability or degree of disability;- Disabled persons aged 6 years or older, except in cases of persons with particularly severe disabilities.
the procedure shall follow the regulations on confirmation, determination, and redetermination of the degree of disability.
- Within 5 working days from the receipt of the written conclusion from the competent authority regarding the incorrect issuance of the Disability Certificate in terms of type or degree of disability, the Chairman of the commune-level People's Committee shall revoke the Disability Certificate in accordance with the law.
