The Civil Status Law 2014 stipulates that in cases where a birth registration was made at a competent authority of Vietnam before January 01, 2016, but both the Civil Status Register and the original civil status documents were lost, a re-registration is allowed.
The requester for re-registration can go to the People's Committee of the commune where the birth registration was previously recorded or the People's Committee of the commune where the requester has permanent residence to carry out the re-registration.
Re-registration dossier includes:
- Application form (according to the template) which includes the requester's declaration about having registered the birth but not retaining the original Birth Certificate;- Copy of the entire dossier, documents of the requester, or other dossiers, documents, materials containing information related to the birth content of that person;- In case the requester for re-registration of birth is officials and public employees, or persons currently working in the armed forces, in addition to the above-mentioned documents, a written confirmation from the Head of the agency, unit about the birth details of that person including surname, middle name, first name; gender; date of birth; ethnicity; nationality; place of origin; parent-child relationship must conform to the profile managed by the agency, unit.
Processing time:
- Within 05 working days from the date of receipt of the dossier, the civil registry official will inspect and verify the dossier. If the re-registration is conformable, the civil registry official will carry out the re-registration.- If the re-registration is not done at the commune People's Committee where it was previously registered, the Chairman of the People's Committee must send a written request to the previous registry to verify the retention of such civil status records at the local level;- Within 05 working days from the date of receipt of the written request, the People's Committee of the previous registration place must inspect, verify, and respond in writing about whether the civil status records are retained or not.- Within 03 working days from the date of receipt of the verification result confirming that the civil status records are no longer retained at the previous registration place, if the dossier is complete, accurate, and conformable to the law, the civil registry official shall re-register the birth.
In cases where the requester has a copy of a previously issued Birth Certificate, the birth registration content will be recorded according to the content of that Birth Certificate copy; the parent information will be recorded as per the time of re-registration.
In cases where the requester does not have a copy of the Birth Certificate but the personal dossier, documents are consistent with the birth registration content, the re-registration will follow that content.
If the dossier, documents are not consistent with the birth registration content, the birth content will be determined based on the dossier, documents, officially first issued by a competent state agency; specifically for officials and public employees, persons currently working in the armed forces, the birth content will be determined according to the document from the Head of the agency, unit.
