The article below will address the regulations on the dossier and procedures for issuing road transport business licenses by automobile in Vietnam from January 1, 2025.

On December 18, 2024, the Government of Vietnam issued Decree 158/2024/ND-CP regulating road transport activities.
According to Clause 1, Article 20 of Decree 158/2024/ND-CP, the dossier for issuing road transport business licenses by automobile in Vietnam from January 1, 2025 from January 1, 2025, include:
- Application letter for the Business License following the form prescribed in Appendix I attached to Decree 158/2024/ND-CP;
- A copy or certified copy or certified electronic copy from the original, or electronic copy from the original of the degree, certificate of the person directly managing transport operations;
- A copy or certified copy or certified electronic copy from the original, or electronic copy from the original, or the original Decision on the establishment and regulations of functions and duties of the safety management department of the transport business unit via automobile, or motorized four-wheeled vehicle;
- A copy or certified copy or certified electronic copy from the original, or electronic copy from the original, or the original Decision assigning duties to the transport operator.
The procedures for issuing road transport business licenses by automobile in Vietnam from January 1, 2025 are prescribed as follows:
The transport business unit submits 1 set of application dossiers for a Business License to the Department of Transport where the transport business unit's head office or branch office is located, through one of the following methods: directly, online, or via postal services.
In cases where the dossier needs amendments or supplements, the licensing authority shall notify directly or in writing or through the online public service system, specifying the contents that need to be supplemented or amended to the transport business unit within 3 working days from the date of receipt of the dossier;
Within 5 working days from the date of receipt of sufficient dossiers as per regulations, the licensing authority shall appraise the dossier, issue a Transport Business License via automobile, or motorized four-wheeled vehicle according to the form prescribed in Appendix II attached to Decree 158/2024/ND-CP.
In cases where the Business License is not issued, the licensing authority must provide a written response or notification through the online public service system, stating the reasons.
The licensing authority shall check the information related to the Business Registration Certificate or Enterprise Registration Certificate on the National Business Registration Portal or the Department of Planning and Investment's business information portal of provinces and cities before issuing the Business License.
The receiving of application dossiers and returning of results are conducted at the One-Stop-Shop section of the licensing authority or via postal services. In cases of direct dossier reception at the licensing authority or postal services, the dossier receiving officer shall update the information of the dossiers according to regulations into the Ministry of Transport's online public service system.
The licensing authority conducts dossier processing and issuance of Business Licenses on the Ministry of Transport's online public service system.
