New Regulations on the Tasks of Searching for and Supporting the Transfer of Foreign Technology (illustrative image)

In Article 7 of Circular 08/2015/TT-BKHCN, the tasks of searching for and supporting the transfer of foreign technology include 02 components: technology search projects and technology transfer support projects. The tasks of searching for and supporting the transfer of foreign technology are selected according to 03 principles regulated and meet the following conditions:

1. The technology needed to be searched for and supported for transfer is ordered by the Minister of Science and Technology.

2. The main objectives of searching for and supporting the transfer of foreign technology tasks are defined specifically for each component as follows:

- The technology search project component involves research and building technology profile reports. The technology profile report must analyze and clarify the main information related to the technology, the stages of technology development, the technology holder, and the conditions and feasibility of transferring the technology to Vietnam;- The technology transfer support project component involves technology transfer activities, research, technological mastery, and development. The technology transfer activity must include the transfer of ownership rights or the right to use part or all of the technology from the entity entitled to transfer the technology to the recipient in accordance with intellectual property regulations;

3. The results of the tasks of searching for and supporting the transfer of foreign technology are technology profile reports; foreign technologies transferred, contributing to the formation of new products and services or enhancing the productivity and quality of enterprises' products and goods. The products created from the task have specific application addresses, high added value, and are produced on a large scale;

4. Organizations participating in the task implementation include scientific and technological organizations (having scientific and technological activities appropriate to the technology needed) and enterprises (with demand and commitment to implementing technology transfer). The technology transfer activities in the technology transfer support project component must ensure the participation of at least 02 enterprises and 01 group of scientists and technologists from a Vietnamese scientific and technological organization; have sufficient capabilities (financial, human resources, organization) to execute the technology transfer contract; have a technological development plan and organize product business.

Thus, based on the above-regulated conditions, organizations and individuals develop the explanation for tasks of searching for and supporting the transfer of foreign technology with 02 components: the explanation for the technology search project component; the explanation for the technology transfer support project component, according to Form B-TKCG in the Appendix issued with this Circular.
