This is the noteworthy content stipulated in Circular 01/2019/TT-BLDTBXH issued by the Ministry of Labor, Invalids and Social Affairs on January 2, 2019, detailing the determination of disability levels.
Circular 01 regulates the method for determining the degree of disability according to the provisions of Clause 1, Article 17 of the Law on People with Disabilities. The Council observes the disabled person directly, through simple daily personal activities, using a questionnaire based on medical and social criteria specified in the Disability Assessment Form and other simple methods to identify the type and degree of disability for each disabled person.
Additionally, Circular 01 also guides the identification of the type and degree of disability as follows:
- For determining the type and degree of disability for children under 6 years old:- The Council bases on the application for determining the degree of disability, using the method for determining the degree of disability; interviewing the legal representative of the child and using the "Disability Assessment Form for children under 6 years old" to identify the type and degree of disability.
- For determining the type and degree of disability for persons from 6 years old and above:- The Council bases on the application for determining the degree of disability, using the method for determining the degree of disability; interviewing the person being assessed or their legal representative, and using the "Disability Assessment Form for persons from 6 years old and above" to identify the type and degree of disability.
