Guide for planning contractor selection for regular procurement (Illustrative image)

Decree 95/2020/ND-CP stipulates the planning of contractor selection for projects and for regular procurement under the Comprehensive and Progressive Agreement for Trans-Pacific Partnership. Specifically: as follows:

1. Basis for planning contractor selection for projects:

- Decision on project approval or Investment Registration Certificate and related documents. For packages that need to be implemented before the project approval decision, it is based on the decision of the head of the investor or the head of the unit assigned the task of preparing the project in case the investor has not been determined;- Funding sources for the project;- International treaties, agreements for projects using official development assistance funds, concessional loans;- Market consultation results (if any);- Related legal documents.

2. Basis for planning contractor selection for regular procurement:

- Standards, norms for equipment and working tools of agencies, organizations, units, and officials and public employees; existing equipment and working tools that need replacement, additional purchase, or new procurement for job tasks;- Approved procurement decision;- Approved budget and cost estimates for regular procurement;- Procurement plan for the entire sector approved by the Prime Minister of the Government of Vietnam (if any);- Valuation results by valuation service providers or quotations or results of open bidding online for similar packages (if any).

Note: The contractor selection plan is made after the project approval decision or procurement cost estimate or simultaneously with the project preparation process, procurement cost estimate, or before the project approval decision for packages that need to be implemented before the project approval decision.
